SAN LORENZO VILLAGE HOMES ASSOCIATION
MEETING NO. 1187
November 20, 2008
1.1 CALL TO ORDER - The regular meeting of the San Lorenzo Village Homes Association Board of Directors was held Thursday, November 20, 2008. President Wulf Bieschke called the meeting to order at 7:46 pm.
1.2 SALUTE TO THE FLAG - President Bieschke led the Board and the audience in the pledge of allegiance.
2.3 ROLL CALL - Directors Wulf Bieschke, Mel Medeiros. Margaret Wright, Kathy Martins and Pat Pebelier were all present.
2.O MINUTES FROM THE PREVIOUS MEETING -- Director Bieschke asked for a motion to approve board meeting minutes. Director Martins made a motion and it was seconded by Director Wright to approve Board Meeting #1185, on October 16, 2008 and Work Session #1186 on November 5, 2008. The motion carries unanimously.
3.0 COMMENTS FROM PUBLIC AGENCIES

Total warnings for Castro Valley Command:
Tuazon stated that the collisions for the area decreased, with only 7 in San Lorenzo, one of which was on Royal Ave, which is actually in the unincorporated Hayward area. This would bring the total in San Lorenzo to six (6), which is very low.
Tuazon said that last month there was a complaint about youth who were speeding on motor scooters on Via Alamitos. Patrol was sent out to the area to help catch these youths and letters have been sent to the parents of those they caught.
Tuazon stated that "Avoid the 21" is being headed by Livermore Police Department this year. Starting December 5, 2008 they will have check points set for drunk drivers. They will also be putting more officers on the road, as well as patrols for all agencies participating will be increased during the holiday season.
Director Martins thanked the CHP for its participation in the Association's Halloween Parade and festivities.
3.2 SHERIFFS DEPARTMENT -- Deputy Jason Fiene reported for Deputy Liskey who was unable to be present. He brought Sergeant Staysa with the gang unit due to an ongoing investigation of a shooting that occurred on Via Bregani. Staysa noted that no persons were hurt from the shooting, although several homes were shot in to. He noted that they are working with the San Leandro Police Department where they believe the shooter lives.
Deputy Fiene invited the audience to ask questions about the incident.
Mr. La Point, a resident on Via Bregani, wanted to know if there were any suspects in custody or any further leads. He also asked what the neighbors need to look for, in terms of any future problems or incidences. La Point stated that they have seen a person in the neighborhood with a "bulge" at his waste line, which could indicate that he is carrying a weapon.
Sgt. Staysa noted that they do not have anyone in custody at this time, and have no new leads. He stated that if residents believe someone is carrying a weapon in the area they should call the sheriffs office directly. Staysa stated that he is working hard with his team to catch the person or persons responsible. His department did recover bullets from the area and other evidence which they are sending to the lab to help solve the case, but they do not have the results back yet. He stated that they have interviewed residents in the area, but have not been able to get much information at this time. They are actively working to get more information out of one individual in the area, but are unable to elaborate due to the ongoing investigation.
Sgt. Staysa said that residents need to be aware of any suspicious activity, vehicles or persons in the area and call it in to his department immediately. He said that none of the houses hit appear to be the target, however residents need to be aware of their surroundings. At this point they have no new leads and are no closer to solving the case.
Director Medeiros suggested that the neighbors start a neighborhood watch group. He noted that his neighborhood started one year ago and it helped out the residents a great deal with graffiti and crime in that area. He encouraged neighbors to call in any suspicious activity.
The Administrator noted that she can forward information about crime, meetings, and community activities to all those residents who have email and she asked that residents leave their email addresses with her.
Deputy Fien reported on the crime statistics (See Attachment A). He noted that Kavanaugh Liquors has been hit with quite a bit of theft in the past few weeks. His department did a sting at the store and made nine arrests for possession of drug paraphernalia and drinking in public, but no arrests for burglary.
Fien stated that in the past month his department helped with the Association's Halloween parade and festivities and on December 17, 2008, the citizens academy will graduate and they will be hosting a ceremony for the participants.
Resident Keith Barros asked about and incident on Via Madera early this morning. Fien noted that a woman was beaten by a person who climbed through an open window in her house. They are still investigating the incident.
3.3 Supervisor Lai-Bitker -- Staff member Gene Calderon reported on behalf of Lai-Bitker. He stated that this coming Monday the Hayward Area Recreational District (HARD) would be hearing the BMX track on its agenda for a final approval. He stated that it looks like the HARD board will approve this item at the meeting. Calderon encouraged residents to attend.
Calderon stated that his office is having a volunteer recognition at the San Lorenzo Community Hall on December 3, 2009, from 5:30 to 6:30 pm. They are also teaming up with other cities and agencies to help the food bank with a canned food drive. There are barrels for donations in the Association office, at the Alameda County Fire Departments and at Lai Bitker's office in San Lorenzo.
3.4 Zoning Enforcement Report -- Reports were left for residents on the back table.
3.5 Public Comment - Items Not on the Agenda
Resident Keith Barros reported that he sent an email to EBMUD regarding the water they are storing in the ground. The Groundwater project was supposed to be for drought purposes only. Now they are considering using it for residential use. Barros requested that the Board or the Administrator write to EBMUD to make sure that the water being stored, be used for its original purpose and not for residential consumption. The Administrator noted that she and Director Medeiros would work on such a letter.
Resident Kathie Ready asked that people who live near the ATT boxes email or call the office to report the tagging. She noted that ATT is not going out and proactively covering the graffiti. Residents need to call with the nearest address and the box "number" at 800-288-2020.
4.0 FINANCIAL REPORT
4.1 Approval of October 2008 Expenditures -- Director Martins moved to approve the October 2008 expenses including payroll, Director Pebelier seconds, the motion carries.
5.0 ADMINISTRATOR'S REPORT
5.1 EALI Governance Committee -- The Administrator stated this is Supervisor Nate Miley's committee which is dealing with how the unincorporated areas of San Lorenzo, Cherryland, Castro Valley and Ashland can have more local control over the area. At the last meeting there was a controversial discussion about what can be done to gain more control. It was decided that a large meeting will be held in February 2009 where leaders of each of the areas will be present to discuss their ideas with members of the Planning Commission and the Board of Zoning Adjustment. The Administrator said that she would like to hold an additional meeting here in the San Lorenzo Community hall to meet prior to the February meeting to get more community input.
5.2 State/County Budget -- The Administrator reported that both the State and County budgets are in crisis. The State has a 11.2 million dollar deficit, and it is going to get larger. The Governor has proposed 2 1/2 billion dollars in cuts, and he wants to increase taxes by 1.5%. He is pushing for this to happen very soon, prior to the new legislators being seated in January 2009.
5.3 Other informational items -- The Administrator noted that last month staff member Kathleen Harrigan, who normally takes the minutes got injured, so she was unable to transcribe October's meeting. She thanked Director Martins for taking over and resident Kathie Ready for editing the minutes.
6.0 OTHER BUSINESS (motions may be required)
6.1 Validation of nominating papers from Richard Ogg and Wulf Bieschke as candidates for the Association's Board of Directors.
The Administrator reviewed the election for this year. There were two seats up for election and only two residents who took out nomination papers, Wulf Bieschke the incumbent, and Richard Ogg. The Administrator indicated that both candidates' nominating papers were reviewed by the office and the adequate numbers of signatures were verified.
Director Martins moved to validate the nomination papers for Wulf Bieschke and Richard Ogg, Director Wright seconded, the motion carried unanimously.
6.2 Appointment of two candidates for two positions to the Board of Directors by the Board acclamation per voting and election policy adopted 11/06/06
The Administrator indicated that per the Association's election policy adopted November, 2006 there is no reason to hold an election. Section V, H: Acclamation. If at the close of nominations the number of candidates is equal to (or fewer than) the number of positions to be filled, the Board is not required to conduct balloting for the election of Directors. The Board can find that the positions have been filled by acclamation. A communication to the Members announcing the results of the election/acclamation will be publicized by the Board within 15 days of the close of nominations.
Director Martins moved to appoint the two candidates Wulf Bieschke and Richard Ogg to the Board of Directors by the Board acclamation per voting and election policy adopted 11/06/06, Director Pebelier seconds, the motion carries unanimously.
6.3 Board authorization to file liens against 468 properties (Attachment B) -- The Administrator reviewed the procedure for filing liens on homeowners who are delinquent on their assessment.
Director Martins moves to authorize the Association to file liens against 468 properties who are delinquent on assessments, except for those residents who have agreed to make monthly payments, or those who pay off their account prior to the filing of liens. Director Pebelier seconds. The motion carries unanimously.
6.4 Recommendation of a Board member to serve on the HARD Advisory Committee -- The Administrator asked the Board to make a recommendation for the HARD Advisory Committee.
Director Wright moved to nominate Director Mel Medeiros as the primary member for the HARD Advisory Committee and Director Kathy Martins as the secondary member. Director Pebelier seconds, the motion carries unanimously.
7.0 COMMITTEE REPORTS
7.1 Halloween Committee Report - Directors Martins/Wright
Director Wright read a report thanking everyone who supported and participated in the Halloween Festival and Parade. It was a great success and the community was thanked for coming out to participate.
Director Bieschke thanked everyone behind the Halloween Festivities. He thanked Director Martins for the idea of the parade and for the Association Staff and the Board Members for helping to bring the idea to fruition. The Board is hoping that this will be an annual event.
Director Martin thanked Director Wright for all her help; for staff member Kathleen Harrigan for her help and for each of their family members' who participated in making the event a success. She was very pleased with how it turned out and with all the residents and businesses who supported the event. She was especially grateful to the Sheriffs department for all their hard work and support with the event.
7.2 Holiday festivities - Winter holiday festivities - Director Martins -- Director Martins reported that the Board will be hosting another tree lighting this year on December 9, 2008. The Board has decided to suspend its annual holiday home decorating contest in lieu of a "Winterfest" that will include free pictures with Santa and complimentary food and beverages. This event will be held the same night as the tree lighting, but will precede the lighting. The Board hopes to have entertainment for the lighting and encourages everyone to invite friends and neighbors. Kathie Ready noted that this will be the last year that the Association will be able to use the live tree out front for the lighting. Her husband reports that it is growing a minimum of 4 to 5 feet every year and he will no longer be able to string the lights without a cherry picker or boom. Ready suggested that the Association look into purchasing a fake tree for the upcoming years. She looked into the cost and it would be a minimum of $2000.00 or more.
The consensus of the Board was to have an ongoing fundraiser to purchase a tree for next year.
8.0 PUBLIC COMMENT
Resident Beverly Krall of Via Toyon asked what is happening with the lot that used to occupy the Village Realtors. President Bieschke stated that Tom Clements is going to renovate the house after the New Year.
9.0 COMMENTS FROM BOARD MEMBERS
Director Medeiros stated that he wanted something done about the Village Realtors property. The Veterans Memorial at the sight is overgrown and unsightly. The chain link fence around the property is an eye sore. He stated that he would like to see Clements be held responsible for the condition of the property which is at one of the entrances to San Lorenzo.
Director Wright invited everyone to the Winterfest and Tree Lighting on December 9, 2008 and thanked all the residents who attended the meeting.
Director Pebelier thanked everyone for attending the meeting.
Director Martins stated that she had the pleasure of working on the San Lorenzo School District's Measure O Committee, and she was happy to see the measure pass. She thanked everyone who supported the Measure.

Director Martins moved to approve the decisions on the hearings and variances except for the four variances that have been continued. Director Pebelier seconds, the motion carries unanimously.
The Administrator noted that there was not enough time to consider these two items, thus this meeting will not be adjourned but will be continued until December 9, 2008 after the tree lighting to continue to hear these two (2) variances. If anyone wants to attend, the meeting is open to the public.
12.0 ADJOURNMENT -- There was no adjournment the meeting would be continued until 12/9/08 to consider the variances continued above.
