SAN LORENZO VILLAGE HOMES ASSOCIATION
MEETING NO. 1185

October 16, 2008


1.1 CALL TO ORDER -- The regular meeting of the San Lorenzo Village Homes Association Board of Directors was held Thursday, October 16, 2008. President Wulf Bieschke called the meeting to order at 7:33 pm

1.2 SALUTE TO THE FLAG -- President Bieschke led the Board and the audience in the pledge of allegiance.

2.3 ROLL CALL -- Directors Wulf Bieschke, Mel Medeiros. Margaret Wright, Kathy Martins and Pat Pebelier.

2.O MINUTES FROM THE PREVIOUS MEETING -- Director Bieschke asked for a motion to approve board meeting minutes. Director Wright made a motion and it was seconded by Director Pebelier to approve Board Meeting #1183, on September 18, 2008 and Work Session #1184 on October 8, 2008. The motion carries unanimously.

3.0 COMMENTS FROM PUBLIC AGENCIES

3.1 CHP -- Officer Tuzaon was on vacation in September; no CHP present at last meeting due to family emergency. National Walk to School week urging kids to go walk to school, showed how kids could walk to school and increase safety. Gave statistics for Traffic and collisions in San Lorenzo, netted out all those SLZ non-village streets; collisions down this last month. Officer Tuazon has said that after his absence the biggest complaint was commercial vehicles cutting through Washington to the Freeway, the truckers get on Channel 19 and are chatting to let each other know that CHP is there. CHP went out after listening to Channel 19 and found that some truckers were trying to cut through.

A homeowner complained to CHP regarding motorbikes with illegal mufflers. He stated that he has called the ACSO the HOA and has yet to call the CHP. Officer Tuazon stated that although the mufflers are illegal if they saturate an area to try and catch these kids they will move to another area. Homeowner Bev Krall stated that traffic on Hesperian has gotten worse and is concerned that people are running through the lights, possibly being distracted by the construction at Wal Mart.

Homeowner Mr. Clowser made a comment about the solar powered trailers and asked if the CHP had those to provide or there was any less collisions due to the fact that those are present. There is one on Center Street in front of the school but there is also a new traffic light, he believes they work but doesn't have the solar powered trailers one. Keith Barros wanted to know who they would ask to find a permanent trailer; Officer Tuazon said to contact Alameda County.

3.2 Sheriff's Department -- Paul Liskey provided crime statistics for September and October year to date. First tomorrow night is their annual cop shop BBQ which is one of two fundraisers to pay for the rent for the Cop Shop. There will be a lot of raffle prizes and a silent auction. The Sheriff will be there to speak and showing a video for the Operations Urban Shield. They started 19th annual citizens academy with 55 students, they encourage everyone to attend; they will have another in the spring time to learn about the Sheriff's department, equipment, etc. They conducted one alcohol minor decoy the results of the first operation 7 out of 13 stores sell alcohol to a minor, over 50%. The second operation sold 3 of 6 to minors, again over 50%. The person who sells the alcohol is not tied to the business and is taken care of through the Hayward Hall of Justice, but the business will be in violation of the ordinance, and will go in front of the BZA and the ABC and they will impose penalties. Penalties include revocation of license, fines or removal of alcohol license. Update on illegal vendors in the last two months is that they have arrested 18 of them. They have worked out a deal with the DA's office to move forward with prosecuting these people. They take the entire product in as evidence, and hopefully as we move forward we will be able to keep them to a minimum.

There was a homicide on 167th Ave, 3 houses away from their office. They have arrested all 3 people in conjunction with the homicide and took up a substantial amount of time for the ACSO.

The Medical Marijuana dispensary on Lewelling Blvd was shut down by the DEA. If they try to reopen for business they will be pursue federal charges, they only had a search warrant. The items were seized as were all products on the property, they don't believe there was any violation of the county ordinance. Director Pebelier stated that she was on Lewelling Blvd, three weeks ago when the clinic was still in operation and there were a lot of cars were stopping and looking at the facility and two made an illegal U Turn in the middle of the street to visit the clinic. It was a very poor location for any type of business and cause a lot of traffic issues at it was a very dangerous location. Since its closing the Sheriff's Department have noticed less traffic on Hesperian Blvd. There is a meeting of the marijuana ordinance October 30th at 6PM at Supervisor Nate Miley's office. We still have an ordinance that allows three dispensaries in the unincorporated area, so we need to speak as a community of what we think about the ordinance. The Attorney General released a statement about the way these dispensaries should be run, but it is a very gray area and needs to be incorporated into our county ordinance so that we can properly control them.

Director Bieschke asked if the California Attorney General got back regarding our ordinance versus the Federal Attorney General's ordinance. The Administrator made a comment that the Sheriff Advisory Committee was meeting and that we should probably let the Sheriff know that we appreciate the departments involvement in the ordinance. Deputy Liskey stated that although the Sheriff is elected official they take a lot of stock in the public opinion, and we can mail or email them to the Sheriff directly.

6.1 Bayside Grounwater Project (timed agenda item 8 PM) -- Representatives from EBMUD to present alternative landscaping techniques and to talk about the drought and Bayside Groundwater Project. (Handout included) Greg Chan, Public Affairs office, EBMUD Project Manager, Tom Francis senior engineer waterside improvement, Bayside Project.

Bayside Groundwater Project at the end of Grant. Handouts explain how we receive our water from the mountains and how they go to the Reservoir. Why do we need projects like Bayside? If we have another dry year we could be approaching a severe drought, so we need a wet year. When we have a wet year and the river is flowing than we have more than enough water to meet our needs, however in a dry year we have a significant cut down in the supply. At that point we have to focus on conservation, recycling and rationing. After this year we will have the Bayside project that will cut down on rationing. The Bayside project is expected to last until 2020 and is located at the end of Grant Ave.

Bayside in the simplest terms means we have groundwater well and it brings the water at 500 ft beyond ground level. It is natures way of creating a way to store the water to keep it from being polluted. The same water that we store in the ground can be extracted during the dry times because the water is highly treated but we will have a treatment plant to treat the water after extraction. EBMUD also have a monitoring system in place to monitor the PH level, magnesium, basically all the drinking water standards. And finally previously there was concern from Heron Bay that EDMUD would do things that would impact the ground service elevation to monitor ground service. They have 26 monitoring wells including ground service monitoring.

Director Bieschke said that he understood that this was for drought times only, but he heard that they will be storing continuously and pumping into our drinking water. Mr. Francis stated that this is only for Drought circumstances and will not be running it 24-7. This year would be a good example for a year in which we will use this water. Greg Chan stated that we will be having a committee with EBMUD that is the community input group which addresses public concern. We will need to appoint a new member on this committee as we haven't had one since Patrick Ledesma. Director Bieschke also asked if this was in fact a test project because it is a real small project. Francis stated that this is a test project and probably the first of many phases, and the agencies nearby wants to make sure that they ground is not impacted for other agencies. If they do expand they will look to the north for bigger facilities in 5 to 10 years. Chan said if they were to expand the project it wouldn't happened without a lot of input from the community.

Director Medeiros stated that Hayward water isn't as good as EBMUD and wanted to know why is EBMUD pumping water into the aquifer when everyone else is taking out? Francis states that we need the water during dry years but the idea is during wet years we would store the water to reintroduce the water and through treatment bring back the quality. We will end up drinking the Pardee water and the mixed ground water. Director Medeiros stated that there is a creek that runs along Channel, Via Catherine and Bockman and they have Dead End zones that they never replaced those mains. So how would they mix the water with the remainder of the water, it would not just be ground water that people drink it would always be a mix. Director Medeiros stated that when he worked in South Wells that they couldn't find the tags they put on the wells. Francis stated there hasn't been any pumping as of yet and they have just drilled wells. Director Medeiros apologized for saying that they were pumping water last meeting.

Homeowner Lou Orselli talked about a leak he had at his house that he fixed but apparently the quality of water in his home has changed. They put the water through a Brita filter and it has a tint and smells like chemicals. Francis suggested that he call the customer service line but says again that Bayside hasn't started. Mr. Clowser asked if they were only going down 500 feet would there still be in Freshwater? The aquifer is full of water right now, natural ground water and the treatment would bring the good water in the middle out of the middle. Clowser stated that the last time there was a drought EBMUD had to mix the water and was not the best quality weather. The administrator explained that we were supposed to be apprised of the progress and we haven't had an update in over a year and it should be required to update us quarterly.

Greg Chan agreed that we should have more frequent meetings and updated but we should only be having these when there is something to report. Thus far nothing has been done that was not originally approved and discussed. Homeowner Keith Barros stated that this is the first time he has heard that the water was going back into our drinking water as a mix of ground water. His concern is the DEAD END issue which he is not opposed to but stated that we should be fixing the mains to improve quality of our current water.

Chan stated that artificial turf is eligible for $1000 rebate but schools and stuff that have used it have to replace in 6 or 7 years at a considerable cost. They are doing the rebate but are doing it cautiously. They have a lot of rebates and they should check their website to see what we might be eligible for. Chan gave us a book that has alternative options for landscaping that will be bring our water bills down.

3.3 Supervisor Lai-Bitker -- Gene Calderon from Supervisor Lai Bitkers office stated that the San Lorenzo initiative has wrapped up and they had over 300 responses and there will be a meeting of the committee in November to review the findings. There will also be a public meeting January to release the finding and thanked the community for their participation.

They are going to have a holiday party December 11th at the district office on Hesperian and will be doing a food drive and want to put a barrel at the HOA. Director Pebelier stated that they should check with the bank because they usually have barrels for food drive. The San Lorenzo Youth Collaborative meeting will be held the last Wednesday of the month. Director Martins asked about the progress of the BMX track, Gene sated they haven't heard back from the arborist.

3.4 Zoning Enforcement Report -- County Code Enforcement left a report for the audience and board to review.

3.5 Public Comment - Items Not on the Agenda

Tom Murphy, 15929 Via Alamitos, stated that he has called the police and HOA regarding the motor bikes with illegal mufflers. He is very annoyed and doesn't feel like he is getting anywhere and should be allowed to enjoy peace and quiet in his own home.

Sung Lee, the owner of Hesperian Cleaners , came to thank the HOA and homeowners for voting and helping him win a National award for being a green cleaner. When he won the award they asked him where San Lorenzo was! He is the first person in Alameda County to win an award. On SF Gate.com he was awarded the second place on their online service. He feels like all of these awards really put SLZ on the map and will continue to do whatever he can to help the community.

Jim Sherman, 15743 Via Regio, asked for everyone to vote Yes on Measure O and announced that he was running for school board and asked for us vote.

4.0 FINANCIAL REPORT

4.1 Director Wright moved that we approve the September 2008 report, Pebelier seconded, motion carried.

4.2 The Administrator reported that there were no significant variances.

5.0 ADMINISTRATOR'S REPORT

5.1 Administrator announced that four homes have closed at Village Walk and they have all paid their dues.

5.2 Administrator went over EALI Governance Committee alternatives. Director Bieschke said that he doesn't believe that Alternative 3 (as listed in the handout) would be feasible as it would be adding another layer to the planning commission. Kathy Ready stated that the learning curve for the planning commission is extensive. The administrator stated that we need to focus on the structure and not the persons who sit on the committee we need to plan on the future and not focus on individual members of supervisors. The Administrator stated that the most important part of the proposal (Suzanne Barba's) is the public appointment system. Kathy Ready believes the supervisors have the right to appoint who they wish to each position and shouldn't have to be open to public opinion.

Keith Barros stated that Alternative A was unacceptable and that the mini-macs should not be discussed at EALI. However he believes that Nate Miley will still try to push this item through.

Don Clowser,1155 Via Vista, stated that the Supervisors will not give up any powers that they currently have. He would recommend to the Board that they write a letter and voice our concern and concentrate on our CC&Rs and stop trying to hold things up.

Director Bieschke directed the Administrator to write the letter with the Board's decisions. The last comment is on the community manager and we still advocate for the appointment. Director Pebelier moved that a motion be made to instruct the Administrator to write a letter, Martin seconded.

5.3 There will be a hearing at the BZA for a telecommunications company to continue using the tower.

6.0 OTHER BUSINESS (motions may be required)

6.1 Hesperian Streetscape -- There is a redevelopment subcommittee which Kathie Ready volunteered be on. There are some changes on the streetscape as it was originally supposed to be a few years ago, particularly as it related classic style and now the suggestion by the consultant, confirmed by the redevelopment committee is Art Deco. The committee and RDA will come back to us before a final decision is made.

7.0 COMMITTEE REPORTS

7.1 Marijuana Committee -- Director Bieschke reminded everyone of the meeting at Nate Miley's office.

7.2 Halloween -- Director Martins thanked the community for their support and said that we couldn't do anything without the support of our public agencies.
