SAN LORENZO VILLAGE HOMES ASSOCIATION
MEETING NO. 1085

October 16, 2003


The regular meeting of the San Lorenzo Village Homes Association Board of Directors was held Thursday, October16, 2003.

1.1 CALL TO ORDER -- President Kathie Ready called the meeting to order at 7:35 at pm.

1.2 SALUTE TO THE FLAG -- President Ready led the Board and the audience in the pledge of allegiance.

1.3 ROLL CALL -- Directors Kathie Ready, Pat Pebelier, Enrique Barboza, Jim Sherman, and Peggy Sheridan were present.

2.O MINUTES FROM THE PREVIOUS MEETING -- Director Sherman moved to approve the minutes from the September 2003, meeting Number 1084. Director Barboza seconds the motion. The minutes are approved unanimously.

3.0 COMMENTS FROM PUBLIC AGENCIES

3.1 CHP -- Officer Plant Reported on the following statistics for September 2003:

Total Warnings for Hayward Area CHP: 1,602
Officer Plant reminded parents to dress children safely on Halloween. He stated that they will have more patrols out on Halloween night. Plant reported that the railroad will be blocked off at the end of Grant Ave in San Lorenzo on November 1 and 2nd for work on the street and the railroad in that area.

Resident Steve Daly asked that the CHP to continue patrolling the parking on Alamitos which has gotten worse again. Officer Plant noted that he had brought some warning notices that the CHP will put on cars parked inappropriately (when they are not actually ticketing a vehicle). He stated that residents could get additional copies of these warnings in the CHP office. Resident Kathy Bosley asked about who the speeding citations are being given to in San Lorenzo. Plant noted that a majority of the tickets are issued to residents in the area.

3.2 Sheriff's Department -- Technician Lemmon stated that they participated in the Lorenzo Theater Fall Festival and will have a Crime Prevention Meeting for the public about evidence collection on November 5, 2003 at 7 p.m. at Bay Elementary School. They will continue these monthly meetings highlighting different topics throughout the school year. Lemmon noted that her department will also be participating in the upcoming Children's Halloween party hosted by the San Lorenzo Homes Association on Wednesday, October 29, 2003. The new Cop Shop is set to open sometime in November or December of this year. Lemmon also stated that the neighborhood watch meeting with residents from Via Madera went very well.

Lewis stated that the Mervyns parking lot was reported to have multiple cars "for sale" on the weekends as well as an unauthorized "flea market" being conducted in the Citibank parking lot on several of the past weekends. Lewis stated that they need to get an open-ended complaint signed by the property owner authorizing the sheriff's to take care of any unauthorized activity on the property. He stated that as far as the cars that are "for sale" on the lot. The property owner has its own method of enforcement and towing in place and they have been posting warnings on vehicles.

Lewis stated that at the "alledged" prostitution at Hot Tropics is not happening from the business itself, but may be happening due to the fact that clients can rent rooms by the hour. Lewis said that he has spoken with the owner who has assured him that he will contact the sheriff's department if he notices any "suspicious" activity. Resident Keith Barros stated that he was concerned with the fact that the back doors are left open. Lewis said that the owner is also very concerned about the problems that have been noted at his facility and is appreciative of the community's concerns.

Lewis said that with respect to the promotional music signs on community poles, he has talked to one of the promotional agents who has agreed to take these signs from the poles. Lewis also spoke with Rasputin Records to help prevent people from posting the signs. He stated that the way the county ordinance reads county staff must actually see the people hanging the signs in order to prosecute them. The ordinance applies to all people hanging signs from anyone who puts up a "lost dog" sign to a garage sale sign. Lewis stated that the one promotional manager who stated that he would stop posting his signs on telephone poles in the area.

3.3 Supervisor Alice Lai-Bitker -- Staff member, Kevin Dowling, reported that he went with the Association Administrator to tour the highways 238 and 880 with CalTrans that are in need of landscaping and clean up from trash and debris. Dowling stated that LAVMA sewage reclaimed water is being used to water 880 near 98th Ave to help maintain that landscaping and they have cleaned up the 880 corridor, however they claim that they do not have the funds to do further landscaping on 880 as promised. Dowling also reported that he is dealing with the road crew who did work on Via Media and left debris in the gutter.

8.4 Approval of the Library Lease (Timed agenda item) -- The Administrator said that at the last board meeting they had talked about the library lease being changed and asked that the library draft a new lease which their legal counsel did and which was reviewed by the Association's attorney and then forwarded to each board member ( See attachment A). The new lease would give the library Association land to the alley(but not include any of the playground land) and would also give them additional land from Bohannon near the back of the current facility. The new lease would be contingent upon grant money being obtained to enlarge the library.

Director Sherman made a motion to accept this new lease and to authorize Board President, Kathie Ready, to sign this lease on behalf of the Association, should the library obtain the grant funding needed to enlarge its facility. Director Pebelier seconds the motion is carried unanimously.

County Librarian, Linda Woods, thanked the board for its support.

3.4 Public Comment - Items not on the Agenda -- None.

4.0 FINANCIAL REPORT

4.1 Approval of September 2003 expenditures and discussion of significant variances -- The Administrator noted that there were no significant variances since the last board meeting. Director Sheridan made a motion to approve the financial report including payroll, Director Barboza seconded the motion which passes unanimously.

5.0 LIEN AND VIOLATION REPORT -- The Administrator reported there have been no liens released since the September Board meeting.

6.0 ZONING AND VARIANCE ISSUES

6.1 Variances approved/disapproved at the work session --

A. 388 Via Coches -- bedroom addition and kitchen with a 5 ft setbck and a new garage with a 1'6" set back. Approved.

B. 34 Via Morella -- 12x14 ft shed with a 9 ft peak and 8 ft walls (policy 10x12 shed); this owner's yard is 1/4 an acre shed to match existing house. Approved due to size of lot.

C. 1591 Via Buena Vista -- Extend back yard 6 ft redwood fence out towards Via La Jolla with a 10 ft setback. Denied and referred to the county traffic engineer.

D. 1203 Via Coralla -- Back yard shed application 12 by 10 in size with a peak no higher than 10 feet and the walls no higher than 8 ft. Shed would have a 2 ft set back from fence line on Via Coralla and Via Alamitos (corner lot). Approved.

E. 1784 Via Lacqua -- 6 ft fence with 1 ft lattice coming out 12.5 ft setback from Via Nueva (enlarge back yard). Denied and referred to the county traffic engineer.

7.0 ADMINISTRATOR'S REPORT

7.1 Informational Items -- The Administrator announced that John Partridge had spoken about Oro Loma a year ago regarding a new recycling truck that would run on low polluting fuel but would require curb side pick up. There were concerns from residents at that time that the street sweeper might have a problem getting to the areas with the cans in the way. There were other concerns about vehicular and pedestrian problems, and how unsightly this would look in the neighborhood. Partridge asked if the Board had any recommendations at this time with respect to the service.

Director Ready noted that her garbage bill had increased despite the fact that ORO LOMA said it would only increase the bills where the service was provided. Director Sherman asked if the Board had ever received an answer to its question about the legal authority should these cans cause any property or personal damage. Partridge could not recall any response from ORO LOMA regarding this question. The Administrator stated that she will put this item on the November 2003 agenda so the Board can discuss this item further and act upon it.

The Administrator stated that last year the county helped the Association out during its heavy leaf sweeping season, Oct-Dec, by providing two (2) county vacuum trucks with crews. She stated that due to the budget cuts this year the Association would be lucky to get one (1) truck without any crew behind it. She asked if the Board would be amenable to funding workers to help the county truck sweep and vacuum up the leaves during the heavy season. She would only hire additional personnel if there were funds within the budget to do this. The Board had no objections to looking into this idea to see if the Association could hire out additional help during the heavy leaf season.

8.0 OTHER BUSINESS

8.1 Discussion of Fence Policy -- (See attachment B) The Administrator noted that the Association does have a fence policy and handed out the document. She stated that the county is looking at changes to their laws regarding fences but until they do she suggested that the board maintain its current policy. The Board's consensus was to retain the current policy until the county reviews its laws and makes changes regarding fence.

8.2 Election Schedule for 2004 -- (see attachment C) The Administrator noted that the schedule would be posted in the newsletter and all the procedures for this election are consistent with previous years. elections schedule for 2004. Director Sheridan made a motion to approve the election schedule/procedures for 2004, Director Pebelier seconds, the motion carries unanimously.

Resident Keith Barros asked if there will be security for the ballots. The Administrator noted that this was discussed last year and will be in place if an election is needed for 2004.

8.3 Approval of audit for FY 2002-2003 -- ( See attachment D) The Administrator asked the board to approve the final draft of the audit that was mailed out to every homeowner. Director Sherman made a motion to approve the final audit for the FY 2002-2003, Director Barboza seconded, the motion carries unanimously.

8.4 Discussion on Amended Library Lease (See above timed agenda.)

9.0 PUBLIC COMMENT -- Resident Keith Barros congratulated President Ready on her most current newsletter article and announced that the Lorenzo Theater's Fall Festival will occur this Saturday.

Resident Dorothy Partridge asked what the status of the property on Washington and Grant The Administrator noted that the plans had been approved last month and she would refer this to zoning.

Resident Liz Thayer asked whether something could be done to declare that area a "public nuisance". Kevin Dowling stated that he will contact the sheriff's department with respect to the condition of the lot.

The Administrator announced that Pete Stark would be holding a Town Hall meeting at the San Lorenzo Community Hall on October 18th from 10:30 to Noon and urged residents to attend. She also announced that there would be a Health Care meeting hosted by the League of Women Voters and Supervisor Lai Bitker's office on September 25, 2003 at the Eden Medical Center.

10.0 COMMITTEE REPORTS

10.1 Airport Committees -- Ernie Delli Gatti reported that back in July 2003 he had a meeting at Supervisor Lai Bitker's office where Pete Stark and the representative from the FAA were present. Since that time he has sent out a letter to Stark and the FAA with suggestions on how they could reduce the noise complaints from the Hayward airport. He has not had a response from them yet due to the fact that the letter was just delivered.

Delli Gatti stated that at the Oakland Airport Noise meeting there were reports for noise complaints from July through September 2003. The majority of the complaints (60%) were coming from the Fremont area, with only 2 % from San Lorenzo. The Oakland airport is concentrating on limiting the complaints in that area. Delli Gatti encourage residents to call the Oakland airport if they are having problems with noise from the airport.

He said that he had also spoken with the Hayward Airport manager Brent Shiner about the life guard flights to and from the airport. These are the flights that bring in medical organs to the various hospitals and were unregulated as to hours and noise. Due to Delli Gatti's inquiries, the flights now have to fill out a form when they fly into the airport to identify when they are coming in and out of the facility so that they can identify when these type of flights are violating the noise ordinance.

10.2 Library Committee -- Director Pebelier discussed how the county library is trying to get money to help construct the new library. She stated that it does not look like San Lorenzo will get funded with Castro Valley needing funds, however they are trying to get public funds equaling 35 % of the total grant funds in order to even be able to apply for the grant in January 2003.

11.0 COMMENTS FROM BOARD MEMBERS -- President Ready thanked all the residents and staff for attending the meeting.

12.0 ADJOURNMENT -- President Ready adjourned the meeting at 9:04 p.m.
