SAN LORENZO VILLAGE HOMES ASSOCIATION
MEETING NO. 1183
ANNUAL MEMBERSHIP MEETING

September 18, 2008


1.1 CALL TO ORDER - The regular meeting of the San Lorenzo Village Homes Association Board of Directors was held Thursday, September 18, 2008. President Wulf Bieschke called the meeting to order at 7:33 pm.

1.2 SALUTE TO THE FLAG - President Bieschke led the Board and the audience in the pledge of allegiance.

2.3 ROLL CALL - Directors Wulf Bieschke, Mel Medeiros. Margaret Wright, Kathy Martins and Pat Pebelier.

2.O MINUTES FROM THE PREVIOUS MEETING No. 1181 on August 21, 2008 and work session #1182 on September 2, 2008. Director Medeiros made the following correction to the Minutes of meeting No. 1181: page 4, line 7, should state that "HARD monies were 12 million and San Lorenzo would be allocated 1.2 million". Director Martins makes a recommendation to approve the minutes as corrected, Director Pebelier seconds, the motion carries unanimously.

3.0 COMMENTS FROM PUBLIC AGENCIES

3.1 CHP -- Unable to be present. No statistics were available.

3.2 Sheriffs Department -- Deputy Lucket reported for Deputy Liskey who was on vacation. She left the crime statistics for the audience to review.

Lucket reported her department participated in Urban Shield this weekend. Departments as far as Los Angeles participated in the event. The Alameda County Sheriffs Department came in fourth in the competition. Los Angeles County Sheriffs Department came in first, Fremont came in second place and third place went to Sacramento.

Lucket stated that the following events are up and coming: Oct 8, 2008 the Sheriffs Citizens' Academy for all residents to learn more about the Sheriff's department.

Oct 17, 2008 The Cop Shop Barbeque is a fundraiser that helps the Sheriffs department rent out its facility at the Ashland Community Center. Tickets will be sold at the Cop Shop and the Homes Association.

President Bieschke asked about a shooting that recently occurred on Via Ventana. Deputy Lucket had no information on it, but stated that she would look into it and would provide information at the next meeting.

3.3 Supervisor Lai-Bitker -- Staff member Gene Calderon reported that his office has been involved with the San Lorenzo Initiative and its survey. They are now doing most of the surveys on-line and will be compiling data in November.

There will be a Fall clean up on Saturday September 27, 2008, This event is hosted by Supervisor Lai-Bitker and Supervisor Miley and participants will meet at 8 am at Meek Estates Park. Calderon left a flyer and stated that if anyone is interested they should contact Anna Gee at 510-891-5585.

The Unincorporated meeting will be discussing the bicycle and pedestrian draft plan.

3.4 Zoning Enforcement Report -- County Code Enforcement left a report for the audience and board to review.

3.5 Public Comment - Items Not on the Agenda

Dennis Waespi introduced himself as a candidate for the Hayward Area Recreational District (HARD). He stated that he is a member of the HARD advisory board and has been active in making decisions for recreation in the unincorporated areas, including San Lorenzo. Waespi asked residents to support measure WW and left hand outs for the audience.

The Administrator reported on a strategic meeting HARD sponsored that she attended with Director Medeiros. HARD asked the community what they wanted to see done with the funds HARD received. They had many community agencies who participated, and it was a productive meeting. The Administrator stated that this is the first time HARD has proactively come into San Lorenzo to ask what it wants and needs. Waespi stated that the District is reaching out to all communities to assess what they want. It will continue to do this and base its five year draft plan and final plan on the input it receives from the community.

4.0 FINANCIAL REPORT

4.1 Approval of August 2008 Expenditures and discussion of significant variances -- The Administrator reported that there were no significant variances. Director Martin makes a motion to accept the financial report, Director Wright seconds, the motion carries unanimously.

5.0 ADMINISTRATOR'S REPORT

5.1 Report on outcome of Ratto court case re: CC&R enforcement -- The Administrator reported that after five years, the Association found it necessary to take a homeowner to court. The Association prevailed and the Administrator read the decision from the judge and noted that the homeowner does have the option to appeal.

5.2 Report on Ratto-Gomes Case re: By-Laws -- The Administrator reported that two homeowners submitted a petition that was signed by several hundred homeowners requesting that the newest By-Laws be repealed. The Association's attorney determined the petition was not accurate and the petitioners subsequently withdrew their case prior to it going to court. The Administrator also noted that one of our homeowners appealed a County Board of Adjustments decision before the Board of Supervisors and lost their appeal, which is in favor of our CC&R enforcement on the property.

5.3 State Budget Update -- Administrator reported that the current budget proposal is horrible. One of the main areas that will hurt our community is in relation to redevelopment funds. They are proposing a 300 million cut in funds of which approximately 7% of that will come from city and county redevelopment funds. This could affect our development of the Mervyns square area. The other cuts that would affect our community are related to the library.

The Administrator said she received a proposal for a variance from the county to allow the Usher Inn to expand its services to make it more of a "Cabaret", rather than a bar. This would allow it to serve food along with alcohol.

The consensus of the board was to have the Administrator write a letter on its behalf suggesting that it deny this application because of increased noise, traffic and too many alcohol outlets in the area.

6.0 OTHER BUSINESS (motions may be required)

6.1 Discussion and possible endorsement of Measure O San Lorenzo School Bond -- Dr. Dennis Byas, Superintendent of San Lorenzo Unified School District, came back to address the board and answer any other questions. He noted that at this point there is no opposition on the ballot. The new bond would cost homeowners the same amount as the last bond Measure E and would help continue what Measure E has started with school improvements.

Director Martins noted that none of this money is going to be used for teacher or administration salaries, but will be used for capital improvements. She asked Dr. Byas what the priorities would be for these funds. Byas stated that safety is a top priority, also replacing portables with classrooms and working to improve the athletic fields.

Director Medeiros made a motion to support Measure O, Director Martins seconds the motion carries unanimously.

7.0 COMMITTEE REPORTS

7.1 Marijuana Committee -- Director Bieschke reported that this issue had been continued by the Board of Supervisors and he would have a report next month.

7.2 Halloween Committee Update - Directors Martins/Wright -- Director Martins stated that the Association has grown out of its facility for the annual children's party and so the Board has decided to take this event outdoors, with a parade and a festival type atmosphere on 10/25/08. The parade will start at the community church at the end of Paseo Grande and will march up to the old Mervyns square area where there will be fun, games and more. The library will have story time and the Alameda County sheriffs will be doing children's ID and fingerprinting. Volunteers are needed and community sponsorship. There were flyers given to the audience to solicit donations and help for the event. Martins asked that residents get the word out about this event. Children 12 and under and their families were encouraged to attend.

7.3 HARD meeting - Director Medeiros reported that HARD is looking into their five year plan. HARD is having difficulties with funding just like every other organization, with foreclosures and the state of the economy. Medeiros mentioned that measure WW will help with some of this and encouraged residents to look at the hand out given and to support the measure.

Director Wright made a motion to approve the Hearings and Variances, Director Martings seconds, Motion carries unanimously.

10.0 PUBLIC COMMENT

Resident Kathie Ready stated that she is part of the tree committee that reviews the cutting down and trimming of trees in San Lorenzo under the Alameda County tree ordinance. She stated that most of what they are reviewing is sycamore trees that have been improperly pruned or removed. She asked the board and the Village Briefs to publicize the benefits of trees in our community. She noted that there is a homeowner on Via Colusa who recently purchased his house and wants to remove the sycamore. Not because it is diseased but because he doesn't like the leaves. He is appealing this to the Board of Supervisors. She stated that new as well as old owner need to be educated about trees and our neighborhoods.

Resident Keith Barros said that the State taking redevelopment funds is horrible. He would also like to see the Village briefs note something about those homeowners who do not comply with the CC&Rs and cost us several thousands of dollars in court fees, thus eventually increasing our assessments.

Resident Lois Moser of 15728 Via Sonata read a letter she forwarded to the President of the Board about her property and her neighbors adjacent property. She was concerned with the CC&R enforcement regarding her neighbor's property and the fact that he has paved his entire back yard. She referenced a July 2004 excerpt from the Association minutes and stated that she would like a response to her letter within 10 days.

Resident Marvin Kingdom stated that he has seen every single sign up and down Via Alamitos tagged. Association staff noted that they had called the county on two occasions and would follow up again.

Director Martins read an article that was in the San Francisco Chronicle regarding a home in San Lorenzo that was highlighted for its creative and unusual use of building materials.

11.0 COMMENTS FROM BOARD MEMBERS -- The board thanked residents for coming to the meeting.
