MINUTES
SAN LORENZO VILLAGE HOMES ASSOCIATION
MEETING NO. 1070
September 19, 2002
The regular meeting of the San Lorenzo Village Homes Association Board of Directors was held Thursday, September 19, 2002.
1.1 CALL TO ORDER -- President Kathie Ready called the meeting to order at 7:39 pm.
1.2 SALUTE TO THE FLAG -- President Ready led the Board and the audience in the pledge of allegiance.
1.3 ROLL CALL -- Directors Kathie Ready, Jim Sherman, Pat Pebelier, Peggy Sheridan and Enrique Barboza were present.
8.2 Proposed trucks for San Lorenzo recycling --Oro Loma -- Administrator asked that an agenda item be moved up on the agenda due to the work schedule of one of the staff members present who has to get up at 4 a.m. the next day there were no objections from the Board.
Marta Boerger spoke on behalf of the Oro Loma sanitary district regarding the flyer that went out proposing new recycling trucks for the San Lorenzo area. She stated that no decisions have been made as of yet. This is just a proposal. Oro Loma is trying to get public input prior to implementing anything new. Boerger stated that Waste Management approached Oro Loma regarding these vehicles which are automated and "clean air"-and would benefit the environment There have been some concerns regarding these new vehicles due to the fact that the recycling cans must be put out up against the gutter. Street sweeping in certain areas could be affected as well as the problem of residents leaving the cans in the gutter creating parking problems and blight.
Mark Arbaugh, Operations Manager of Alameda County stated that these automated trucks have been utilized in the Fremont area and the Castro Valley area. He said that safety for the driver and service for the customer is increased through the use of these vehicles. He stated that these are "clean-air" trucks and the only way to service the customer is to have the wheels of the cans placed up against the gutter. The customer no longer has to sort the recycling material in the cans with the use of these trucks. Both Fremont and Castro Valley have worked out some of the same concerns that residents in San Lorenzo are now addressing. He stated that both the areas are happy with the new vehicles and he thinks it can only benefit San Lorenzo.
Director Ready questioned where the cans would be put after they are emptied. If they are put back in the gutter this will prohibit street sweeping in some areas. Boerger stated that they would have to coordinate with the affected municipalities regarding street sweeping so that the can schedule would not coincide with street sweeping.
Director Sheridan stated that homeowners currently leave their garbage cans on the sidewalk all day long until they get home from work-some even longer. She is concerned that the curbs will be cluttered with the cans. Boerger stated that this is a valid concern which she will take back to the Oro Loma Board.
Director Barboza questioned how the drivers would maneuver the vehicles if there are cars parked in the way. Arbaugh stated that the employee would have to get out of the truck and service it themselves.
Director Sherman asked if the curb side bins would prohibit the driver from picking up the other garbage cans. Arbaugh stated that they would not inhibit other services.
Resident Lou Filipovich asked whether Oro Loma would be carrying enough insurance to cover class action lawsuits that could arise from cans being left in the gutter causing pedestrian and automobile problems. Boerger stated that she was unsure what other jurisdictions are doing related to this problem. She would call them and see what they have done to protect themselves from lawsuits of this nature.. Resident Keith Barros asked whether the trucks would be more labor efficient with respect to drivers having to get out of their cars. Arbaugh stated that the new trucks would be more efficient for the driver and for the consumer as well allowing residents to pile all recycling material into the can. This could also encourage more recycling with residents not required to sort the material.
Resident Tim Sheridan asked how elderly residents will maneuver them to the curb when some are already having problems pushing them to the sidewalk. Arbaugh stated that there are exemptions for elderly or handicapped individuals -Oro Loma does not want its customers to put their health or safety in jeopardy.
Director Ready asked what the benefits were to the public either than the fact that residents don't have to sort their recyclables. She is concerned about the residents who already have problems pushing them back from the sidewalk and the fact that people will lose their jobs with these new trucks. There is also a concern with vandalism by school children who travel the streets before and after school when these cans are left in the street.
The Administrator asked why the county couldn't get "clean-air" vehicles that don't require the cans to be put in the gutter-but would pick up the cans at the sidewalk where they are currently left for service. Arbaugh stated that they have not developed a "clean-air" vehicle that can do that as of yet.
Resident Keith Barros asked how these trucks became available to the county. Arbaugh stated that San Jose lost its franchise and so these trucks that were only one year old became available for purchase by Alameda County. He also stated that the route manager from San Jose is now the route manager for Alameda County and he stated that San Jose had few problems with vandalism or carts being left in the street.
Director Ready said that she is interested in hearing back from Boerger as to whether other cities carry extra insurance for potential class action or other lawsuits that could be generated by cans left in the gutter.
Oro Loma Board Member Howard Kerr stated that he is willing to listen to any concerns residents have regarding this type of service. He will make sure the insurance questions are answered. He stated that vandalism is always a concern whether the cans are in the street or on the sidewalk. He would also look into parking issues generated by this service.
The Administrator thanked resident John Partridge for his participation in getting Oro Loma and other staff members to the meeting to address this issue.
2.O MINUTES FROM THE PREVIOUS MEETING
2.1 Approval of the minutes of Meeting No. 1069, Thursday, Aug 15 2002 -- Director Sherman makes a motion to approve the minutes, Director Pebelier seconds the motion carries unanimously.
3.0 COMMENTS FROM PUBLIC AGENCIES
3.1 Alameda County Sheriff's Dept. -- Technician Freda Jones and Deputy. Kevin Lewis reported for the Sheriff's Department. They stated that they have no statistics currently available for August 2002. The person responsible for those statistics in on vacation. Jones stated that the Cop Shop has been involved in a number of committees and events, including the San Lorenzo Youth Collaborative, the Zucchini Festival and the Cop Shops Annual Barbeque. They have also been involved in crime prevention education with the San Lorenzo Community Church and attended a block party put on by residents of Via Nube and Via Alamitos. A new citizen's policing academy has begun with over forty (40) participants.
President Ready questioned what the status of the apartments on Washington Avenue. She had been told that the complex was sold and that the new owner was going to change the current tenant policies and that some positive things would be happening for that area. However, when she drove by these apartments recently, she saw sheriff vehicles and heard that residents there were cited for having firearms and drugs.
Deputy Lewis stated that a new owner has purchased the complex . The owner is Horizon Realty in Oakland. They are working with the sheriff's department to clean up the area. They will be rebuilding the apartments that were burnt down earlier this year and are renegotiating the leases and getting rid of unwanted tenants. Lewis stated that the new owners have cleaned out the pool and eventually plan to re-pave and will make it a gated complex. To alleviate the parking problems they are going to require parking permits for each car in the complex.
Lewis stated that they are investigating the graffiti that occurred last Friday at the Homes Association and have identified two (2) youths. He asked that the Association estimate how much material and labor was done to clean up the graffiti so that he can pass it on to the District Attorney's office.
3.2 CHP -- Officer Greg Schmeck stated that has been reassigned to the San Lorenzo area after attending motorcycle school for the CHP. He stated that there are no statistics available at this time for August 2002, but he will bring them to the next Board meeting. Schmeck stated that his department is focusing on traffic safety around school zones now that the new school year has begun. The CHP currently has more officers in the area and is trying to handle mor violations at or near school zones. They are looking for unsafe driving such as speeding, not stopping for buses or vehicles parking or stopping in loading or bus zones. Schmeck stated that the two (2) problem school zones are Bay and Lorenzo Manor elementary. They are trying to hit all schools, but have been concentrating on these two currently because of the high number of traffic incidents and violations in these areas.
3.3 Supervisor Lai-Bitker -- Kevin Dowling aide to Supervisor Lai Bitker stated that the road construction project that occurred on Bockman Rd was a problem. Apparently the contractor who was hired to do the work never informed the businesses of when the construction would take place. Dowling stated that his office is now working with the county's Public Works Department to send out notices to all affected residents and businesses who might be affected when projects like these take place.
Dowling reported that residents of Via Buena Vista and Via Carmen got a petition for speed bumps in that intersection. The county traffic engineer reviewed the site a proposed a raised intersection for the area. He felt that this type of intersection would work the best for the area. A petition is now being done to see if neighbors would approve of a raised intersection as a traffic calming measure. Dowling also reported that residents on Via Enrico had contacted the Supervisor's office because they are upset about Arroyo High School students and how they are impacting the area. There is excessive trash, speeding and parking violation coming from students who are parking on Via Enrico, near the high school. A meeting is being held on September 30th at Arroyo High at 7 p.m. with neighbors, the Vice Principal and the Supervisor's staff to see what can be done. Dowling stated that there are two (2) options to consider, one is to put up signs prohibiting parking during school hours, or required a parking ticket that they would have to pay for in order to park in that area.
Dowling also announced that the Supervisor's office would be hosting some senior forums throughout her district. They will also be sponsoring a booster seat giveaway on October 3, 2002 in the old Mervyn's parking lot.
The Administrator said that she had a call from a homeowner concerned about new jets being housed and flown at the Hayward Airport. She suggested that the resident, the manager of the airport, Dowling, herself and the Board's airport committee member meet to discuss this issue. Dowling stated that his understanding was that there were no new jets being housed at the airport, rather the new hanger construction was for jets already at the airport. He agreed to coordinate the meeting to discuss this further.
3.4 Youth Advisory Commission -- No report.
3.5 Public Comment -- Resident David Campbell who lives on Via Enrico stated that he is one of the citizens concerned about students at Arroyo High School and how they travel his neighborhood. He stated that his truck was recently wrecked by a student who was speeding through the neighborhood. He stated that the trash in his neighborhood is horrible when school is in session and he is concerned for his neighbor's safety. Many of the seniors who live in the area have trouble walking and parking because of how the students park in the area.. He has brought his concerns to the Principal of the school but no change has occurred. He stated that he has informed the sheriff's office, the CHP, the county Supervisor's office and the School Board about the situation and the upcoming meeting. He stated that there is a parking lot in front of the school on Grant Avenue that is not being utilized like it should. Director Sherman stated that he would be present at the meeting on behalf of the Association.
Resident Jim Cayere from Via Manzanas questioned whether his variance for front yard paving was approved. The Administrator stated that the board approved his variance for pavement of his front yard due to the fact that he lives on a corner lot and with the condition that the rest of the area be grass with no front yard fencing. The Administrator announced that the board has now established a policy with regards to pavement on corner lots, they will be considering the whole front and side yard area on corner lots with respect to pavement.
4.0 FINANCIAL REPORT
4.1 Approval of Aug 2002 Expenditures (including payroll) -- Director Sherman made a motion to accept the August 2002 expenditures (including payroll), Director Pebelier seconds, the motion carries unanimously.
4.2 Discussion of Significant Variances -- The Administrator reported there have been no significant variances.
5.0 LIEN AND VIOLATION REPORT -- The Administrator reported that there have been no liens released since the last Board meeting.

6.0 BUSINESS AND COMMUNITY DEVELOPMENT (BCDC) REPORT -- No meeting this month.7.0 ADMINISTRATOR'S REPORT
7.1 Bayside Groundwater Project
The Administrator stated that the Heron Bay Homeowners had requested that this item be discussed on the last San Leandro City Council Agenda. Dowling interjected that the item was not agendized for that meeting so the only way it was discussed was via public comment. Resident John Partridge, who attended the meeting on behalf of the Board, stated that they way the council handled the item in public comment was to ask all who were in attendance and opposed the project to stand. He stated that the council was limited as to any action on the item because it was not on the agenda, however the council members assured the residents of Heron Bay that they would watch the project and look for the final EIR which would be out in December 2002.
The Administrator said that she has requested the independent report on the project from the Heron Bay Task Force and received a response that stated that this group was not sharing it with other people at this time and that it is confidential and for the Heron Bay Task Force only. Resident Dorothy Partridge clarified that there are two (2) groups involved with this project from Heron Bay. One group is the Heron Bay Homeowners Association, the other is the Heron Bay Task Force which is made up of some residents in the area. She stated that the two groups are working independently and are not communicating with each other.
7.2 Miscellaneous Items -- The Administrator reported that the application for the Santa Fe Party House on Hacienda is coming before the Board of Zoning Adjustments (BZA) this coming October. She said that the Association office had received two (2) letters in support of this facility and its operation. Director Ready stated that the Board had already made recommendations that signs be posted in front of this facility directing the parking into the church parking lot at the end of Via Toledo. She asked that these recommendations be passed onto to the BZA prior to the hearing.
The Administrator also reported that she got a report from the owners of Grant and Washington (the vacant lot) that they now have new plans for this land and are willing to meet with the Association Board to discuss these plans. The Administrator said she has not scheduled this meeting yet and asked the Board how they would like her to proceed. Director Ready recommended that this issue would be perfect for the Business and Community Development committee and requested that it reconvene and review the plans with owners and make its recommendations to the Board. There were no objections from the Board to reconvene the BCDC to review these plans.
The Administrator stated that residents at 17212 Via Alamitos were told that they could keep their garbage cans out front as long as they properly screened them. The residents currently have a screened area and the Administrator stated that staff from Lai Bitker's office asked that Association Board members drive by this property so that their opinion can be considered by the County Supervisor and the NPO staff. The current NPO states that no cans can be out front for more than 24 hours. She stated that she will contact staff at Lai Bitker's office next Tuesday or Wednesday after Board members get back to her with respect to their opinions.
8.0 OTHER BUSINESS
8.1 Presentation of traffic control for Hesperian (timed agenda item at 7:45 p.m.) -- No one was present. The Administrator apologizes for not following up with county staff about the presentation to confirm their attendance. The presentation is computer generated and shows traffic control simulations for Hesperian Blvd. and Paseo Grande. She wanted the Board to review this presentation prior to the Unincorporated meeting this month, however she recommended that the Board members attend this meeting for the presentation. She stated that county staff had indicated to her that nothing would be done about the traffic lights at this intersection until questions regarding the Village Square development were finalized.
8.2 Proposed trucks for San Lorenzo recycling -- Oro Loma -- Moved to one of initial items on the agenda (see above).
8.3 Discussion on donating land to the Library -- The Administrator had a call from the County Librarian and Kevin Dowling after her conversation with Civic Partners. The Public Storage Unit which the developer wanted to purchase for part of its development, has negotiated a sale price for the facility that is not in line with what the developer is willing to pay. Thus, moving the Library and the Homes Association is in question. Land for the library needs to be identified by December of this year so that the library can secure grant funds. The library currently has a 99 year lease with the Homes Association, which after the lease has expired, the land would revert back to the Association.
The Administrator stated that there are three (3) options with respect to the Library, the first would be to demolish the Homes Association Building and the Library and rebuild a facility to house both the library and the Homes Association. The second option would be to demolish the existing library and ask the Bohannon Organization for some of its property near the Post Office. This would allow the Library to expand into a larger facility remaining at the existing site -- with a little more land. The third option would have the library be the main focus of the development at Paseo Grande and Hesperian with housing on top of the facility. The developer would then donate this land to the library.
The Administrator stated that the Association's concern is that if the Library wants to use Association land or if it is donated land that it be assured that should the Library move at any future date, that the land then revert back to the Homes Association.
Dowling noted that there is one other option: that other property in the area be looked at to house the Library.
Resident Dorothy Partridge stated that even if the Library were to get grant funding for a new or expanded facility, that it would have to come up with 2/3rds of the funding itself, with residents having to fund the other third.
8.4 Appointment to San Lorenzo Library Advisory Committee -- The Administrator stated that Supervisor Lai Bitker is helping to form and San Lorenzo Library Advisory Committee. This will be a 21 member advisory committee. The Association Board can appoint two (2) of its members to this committee, plus the Administrator will serve as an ex-officio member.
A motion was made by Director Sherman and seconded by Director Barboza to appoint Director Pebelier and Director Sheridan to the Library Advisory Committee. The motion passed unanimously.
The Administrator stated that she would also be forwarding a recommendation from the Board to Lai Bitker's office for another member from the community, resident Roberta Furger.
8.5 Alcohol sales for Arteaga Market (18400 Hesperian Blvd) -- The Administrator stated that when the market first came to the Board wanting to sell beer and wine it was denied due to the fact that there is a county ordinance which stated that there can only be so many establishments selling liquor within so many square mile of each other. There are currently several other establishments selling liquor within less than a mile from each other. These include Manor Bar, the 7-Eleven across the street, the gas station across the street as well as other establishments. The Administrator stated that the reason the Market has reapplied for a conditional use permit is so that it can sell ethnic beers which tie in with the fact that it is a Mexican market and has an ethnic clientele that cannot get certain beers at other establishments.
Director Sherman stated that regardless of why they want to reapply, he stands by his original vote of not supporting the permit. Director Pebelier stated that the area is flooded with establishments that sell alcohol and she is concerned with how close the facility is to the Bohannon Middle School. Director Ready stated that she has already seen people drinking in public in front of the Work Force/Labor facility located in the shopping center.
COMPRE representative, Emily Chung, stated that the area is already full of establishments which sell liquor and she encouraged the Board to vote against this conditional use permit.
Director Sheridan makes a motion to deny the application for a conditional use permit for Arteaga Market to sell liquor at its establishment. Director Pebelier seconds the motion. The motion carries unanimously.
Director Barboza pointed out that there has been an independent vendor selling chicken and barbequing in the parking lot. He would like to have someone check this out to see if it is legal.
Director Ready suggested that the BZA look into what the permit for Arteaga's allows and to when it comes up for renewal. The Administrator stated that if the market is doing something that is not within the conditional use permit it originally applied for the county can close them down now, prior to any renewal of the permit. Kevin Dowling stated that he will get a copy of the permit and see if they are violating any of it.
9.0 PUBLIC COMMENT -- Resident Lou Filipovich questioned whether the Board knows how the libraries are funded he stated that he had information that is very important and that he would pass on to the Administrator.
10.0 COMMITTEE REPORTS
10.1 Airport Committees -- There were no meetings and thus no report was given.
10.2 Council on the Prevention of Drinking and Driving -- No report.
10.3 Youth Resources -- Dowling stated that he would get an update from Ray Grangoff who is Lai Bitker's new representative to the committee and report on it next meeting. He stated that he knew that the group had broke up into four (4) committees to discuss what youth activities/resources are needed for the area.
11.0 COMMENTS FROM BOARD MEMBERS -- President Ready thanks everyone for attending the meeting.
12.0 ADJOURNMENT -- President Ready adjourned the meeting at 9:25 pm.
