MINUTES
SAN LORENZO VILLAGE HOMES ASSOCIATION
MEETING NO. 1111
August 18, 2005
The regular meeting of the San Lorenzo Village Homes Association Board of Directors was held
Thursday, August 18, 2005.
1.1 CALL TO ORDER -- President Kathie Ready called the meeting to order at 7:35 p.m.
1.2 SALUTE TO THE FLAG -- President Ready led the Board and the audience in the pledge of allegiance.
1.3 ROLL CALL -- Directors Kathie Ready, Jim Sherman, Peggy Sheridan , Director Ledesma and Director Pebelier were absent.
2.O MINUTES FROM THE PREVIOUS MEETING -- Director Sheridan moved to approve the minutes from the July 21, 2005, meeting Number 1110. Director Ledesma seconds the motion. The minutes are approved unanimously.
3.0 COMMENTS FROM PUBLIC AGENCIES
3.1 Alameda County Sheriffs Dept. -- Deputy Franco gave statistics for the past month:

Deputy Franco noted that his department is working on the problem with a rise of stolen vehicles in
the area. Franco introduced their new Sargent, Jim Jukich to the Cop Shop.
Director Ready asked who would be enforcing the new noise ordinance. Sargant Jukich stated that the sheriffs can give a violation notice to offenders of the ordinance. The department just got the notice of the new ordinance and they are in the process of training their officers about the new laws associated with the ordinance. They will be able to start the citation process by the end of the month.
A resident asked what hours can the ordinance be enforced. Director Ready said the ordinance applies 24 hours a day. The new ordinance does not require a decibel reading for citing an infraction. The ordinance leaves the citation up to the officer to consider what is "reasonable" with relationship to the time of day, the situation and the level of noise.

The Administrator asked why the street sweeping signs were not being enforced. She said that even
when they were enforcing the morning side, no officer was coming back to ticket the afternoon cars
parked illegally. Officer Haughn stated he will check with his superiors to see what can be done to
get more enforcement. He noted that there was a fatal accident that happened a few days ago on
Washington Avenue, that was caused by a man who they later found out was having a heart attack.
A resident asked what could be done about an abandoned vehicle on the street that is filled with junk. Haughn asked that the resident report it to their office and they will get an officer out to tag the vehicle. He noted that they average about 270 complaints a month and the officers are doing their best to get to each one of these.
3.3 Supervisor Alice Lai-Bitker -- Staff member, Kevin Dowling, reported on the new Noise Ordinance that went from a decibel reading to a distance/discretionary reading by the officer enforcing the ordinance.
Dowling also noted that his office is investigating train safety in our area due to the high number of deaths this year from individuals hit on the tracks.
He also noted that the Shopping Cart Ordinance will be in affect and the county will be cracking down on stores that do not have a cart retrieval or cart-blocking in place.
3.4 Zoning Enforcement Report -- Bruce Babcock reported on the months violations (See Attachment A). Babcock noted that one of the main concerns in the past month has been boats and trailers which are stored at the front of the property. Babcock stated that zoning gives them 15 days to move the vehicle, then sends a second notice giving them another 5 days. After this final period they get fined $149.00 and for each subsequent 5 days another $149.00 until they clear the violation.
Director Ready asked about the property at Grant and Alamitos. Babcock said that they have all the permits to build. He does not understand why they are not moving forward. He noted that the owner has paid three rounds of fines, for a total of $649.00. He will be going out again next week to recheck the property. Ready asked whether his permit had a condition for maintenance of the lot. How can his plans be re-reviewed by the Board of Zoning Adjustments (BZA) to enforce the upkeep of the weeds and the condition of his lot prior to building. Babcock said that the owner is only in violation of the Neighborhood Preservation Ordinance (NPO). He has not violated any Conditional Use Permits because he has not started to build.
Director Sheridan noted that the lot between Taco Bell and McDonald's on Hesperian is also a problem spot. Babcock said he would talk with the owner this coming Tuesday about cleaning up this property.
3.5 Public Comment - Items Not on the Agenda
Resident Peter Hagberg spoke to the Board about the marijuana ordinance and his belief that it is in violation of federal law. He gave examples of why it was illegal stating that one example is that marijuana can only be dispensed through the federal government. He stated that the county is in violation of the federal law which preempts state law.
He noted that he has spent some time going in and out of these dispensaries and he has observed the clientele. They are young healthy men or women who are visiting these facilities. Because of all these facts he is in the process of preparing a lawsuit against the local ordinance. Hagberg asked the Board to review the lawsuit and vote to support it if they agree with its argument against this new ordinance.
The Administrator noted that the Board could revisit this item at another board meeting after they had reviewed the lawsuit.
4.0 FINANCIAL REPORT
4.1 Approval of July, 2005 expenditures and discussion of significant variances -- The Administrator reported that there have been several things that have come up with the construction project. There was dry rot that needed to be repaired and other things that needed to be repaired as the construction moved along. All of this will be reported in the upcoming audit.
Director Sherman moved to approve the July 2005 expenditures and variances, Director Sheridan seconded. The motion was approved unanimously.

6.0 HEARINGS AND VARIANCE ISSUES

6.2 Variances
A) 515 Grant -- Astroturf for front yard. DENIED.
B) 17109 Via Andeta -- Garage 18" and room addition. APPROVED for garage, other living space
additions have setbacks which conform with minimum 5'.
The Administrator said that the Church on Hacienda is applying to the county to continue its flea markets. The Association is writing to the county regarding the condition of the landscaping and asking that they remind the business to water their lawn.
There is also a home at 17498 Via Alamitos that has applied to the county for a second-story permit with a garage conversion. The Association is writing to object to the garage conversion proposed for this second-story addition.
Director Sheridan makes a motion to approve the hearing and variances as read. Director Sherman seconds, the motion is approved unanimously.
7.0 ADMINISTRATOR REPORT
7.1 Informational Items - The Administrator noted that San Lorenzo Village's 60th Anniversary will be held Saturday, September 10th. Everyone is invited! There will be a parade which will highlight original homeowners and currently has 20 groups involved. At the end of the parade there will be a rededication of the community hall and a street faire. There will be food, children's games and arts and crafts at this faire as well as live performances. The Administrator thanked those business and Realtors who contributed to this event. She acknowledged resident and Real Estate agent, Mary Reynolds, who was in attendance, as one of the big contributors to the event.
7.2 Bockman Center Update -- The Administrator noted that many residents had comments about the initial EIR for this development. She forwarded a letter on behalf of the Association to the Planning Commission and included these concerns. It will take two months to get the report back.
8.0 OTHER BUSINESS
8.1 Civic Partner Update -- (See Attachment B) The Administrator reported that Civic Partners has signed an agreement and will be breaking ground in approximately one year. They have changed their plans and will be putting in 154 townhouses instead of the 380 condominiums. This will have far less of an impact on the community. There will still be 70 senior units that are in the design. The Administrator said that she was hoping that the sale of the town homes would give preference to those who currently live and work in San Lorenzo.
9.0 PUBLIC COMMENT
One resident was upset because the office phone line had not updated the community calendar. The Administrator apologized saying that the staff member was on vacation, it has now been updated.
10.0 COMMITTEE REPORTS
10.1 Airport Committee Update -- None. The Administrator noted that Ernie Delligatti is the Association's representative but had no report. There will be a notice in the upcoming newsletter about the Hayward Airport closing its runways, which will affect San Lorenzo for several weeks.
10.2 Economic Development Update -- The Administrator noted that the committee has been meeting the second Friday of each month in Supervisor Lai Bitker's office. At the last meeting the committee discussed a "Shop San Lorenzo" campaign. The county will be hiring someone through Redevelopment [Agency] to recommend how to highlight businesses in the area.
11.0 COMMENTS FROM BOARD MEMBERS -- Director Ready urged everyone to come to the 60th Anniversary celebration. She thanked those in attendance.
12.0 ADJOURNMENT -- Director Ready adjourned the meeting at 9:11 pm.
