MEETING NO. 1179
ANNUAL MEMBERSHIP MEETING

July 17, 2008


1.1 CALL TO ORDER -- The regular meeting of the San Lorenzo Village Homes Association Board of Directors was held Thursday, July 17, 2008. President Wulf Bieschke called the meeting to order at 7:31 pm.

1.2 SALUTE TO THE FLAG -- President Bieschke led the Board and the audience in the pledge of allegiance.

1.3 ROLL CALL -- Directors Wulf Bieschke, Mel Medeiros. Margaret Wright, Kathy Martins and Pat Pebelier.

2.O MINUTES FROM THE PREVIOUS MEETING -- Approval of Minutes of Meeting No. 1177 from June 19, 2008 and Work Sesson #1178 on July 3, 2008, Director Pebelier makes a motion to approve these minutes, Director Wright seconds, the motion carries unanimously.

3.0 COMMENTS FROM PUBLIC AGENCIES

3.1 CHP -- Officer Tuazon Reported on the following statistics for the past month: Officer Tuazon was not present but left the following statistics:

3.2 Sheriff's Department -- Deputy Paul Liskey went over the statistics for June 2008. (See Attachment A).

He invited everyone to National Night Out which would be held at St. John's Church on Tuesday August 5, 2008. He would be doing a presentation at this event on how residents could put together a neighborhood watch group. He also stated that the sheriff's office will be applying for accreditation in August 2008 and will be having a public meeting in the San Lorenzo Community Hall on Monday, August 4, 2008 at 4 pm. He noted that this is the public's opportunity to voice its praise and concerns about the sheriff's office.

3.3 Supervisor Lai Bitker -- Gene Calderon reported as staff for Lai Bitker. He is here replacing former staff member Kevin Dowling who took another position with the Boys and Girls Club. Shawn Wilson has returned and will be based out of the San Lorenzo office Mon.- Fri. along with Calderon. He stated that he looks forward to talking with everyone.

He noted that next month his office is spear-heading a San Lorenzo initiative, which deals with health care. His office will be conducting a survey on August 10, 2008, going door to door and getting input on access, etc on health care. If anyone is interested in volunteering, please contact the San Lorenzo Office.

3.4 Zoning Enforcement Report (See Attachment B)

3.5 Public Comment - Items Not on the Agenda

Resident Keith Barros stated that there are posters being put up on telephone poles in the village by various business promoting themselves or events. He asked the sheriff's department to look into these posters and encourage residents to pull them down.

Barros said that there is someone selling shoes in the old Mervyns parking lot without authority from the property owner and he encouraged residents in and around Via Andeta to get together to see what can be done to close the passageway to Hesperian. This "alleyway" is littered with trash, liquor bottles and graffiti.

4.0 FINANCIAL REPORT

4.1 Approval of June 2008, Expenditures and discussion of significant variances. The Administrator reported that there were no significant variances. Director Pebelier makes a motion to accept the financial report, Director Martins seconds, the motion carries unanimously.

5.0 ADMINISTRATOR'S REPORT

5.1 Library Service Area -- The Administrator reported on information that has come to her attention about the Library Service area. See Attachment C. She stated that the County Librarian is proposing the elimination of the library service areas of Hillcrest Knolls, El Portal, and Fairmont Terrace from the San Lorenzo service area. The explanation received was that it was a routine administrative move and it did not require any community input. The Administrator noted that these three areas have been part of the San Lorenzo Service area since the inception of the Library. Further, if this type of move is to be made, some believe it should be done through LAFCO. The Administrator spoke with Supervisor Lai Bitker's office and was told they have referred this issue to county counsel to determine the appropriateness of LAFCO. The Administrator noted that many community members believe that eliminating these areas from San Lorenzo will negatively impact our ability to get a new library. She researched statistics to determine what percentage of these groups use the San Lorenzo Library, however could not find any data that addressed this.

The Administrator made the following recommendations to the board: First that the Association wait until it hears the opinion from County Counsel on whether or not LAFCO needs to be involved; second, that we request statistics from the Library regarding the three areas that are being suggested to be moved out of the San Lorenzo Service area. If these statistics are not available, then she would recommend that the Board suggest we suspend any action until they have 6 months of statistics showing which groups are actually utilizing the San Lorenzo Library. Any other action prior to getting these statistics would be premature. Her third recommendation would be to hold a public meeting to explain why it is that the county feels these areas need to be moved out of the San Lorenzo service area.

Dorothy Partridge, the Library Committee chair, stated that she agrees on the recommendations from the Administrator. She feels that the process was wrong, and the fact that the Library Committee was never contacted regarding this issue illustrates that fact. She has called the county librarian and voiced her objections. The Librarian does believe that she has authority to change these boundaries, so Partridge did ask Lai Bitker's office to investigate this further. This issue will be on the next unincorporated meeting and on the Library Commission's meeting on August 28, 2008, she invited residents to attend. She would like to get more facts on the issue and review the impact it will have on the San Lorenzo library and the community.

Betty Moose, President of Friends of the Library, agreed that we should be notified as a community when there are changes like these that may affect the San Lorenzo Library and the whole community.

Richard Hancocks stated that he is concerned that his neighborhood is one of the three that is being proposed to be taken out of the San Lorenzo service area. It has been in the San Lorenzo service area for over 40 years and he is not sure that this is the best time to have less service for the area on an assumption that residents go elsewhere. He had spoken to LAFCO and they have received no application for a change in service area at this time. He would encourage residents and county personnel to look at the affects this change will have not on a neighborhood, but on the community.

President Bieschke noted that the board has concurred with the Administrator's recommendations and will wait for the information that she outlined prior to the county moving forward on this issue. They will be following this item at the Unincorporated Services meeting as well as the Library Commission meeting.

5.2 Other Informational Items -- The Administrator reported there are a number of seats open for local elections this November. Howard Beckman has prepared such a list and copies are available to anyone who is interested. Also, homeowners can check out the SLZ Express website.

The Administrator also reported that there is a meeting related to the ongoing power plant protest on Monday, July 21, 2008. Suzanne Barba spoke as one of the interveners to the proposed plant. Barba stated that the chief commissioner is recommending that the East Shore power plant be denied based on the evidence submitted. However, the decision will not be final until this fall and the company proposing the plant still has the option to appeal. Most of the points that have been brought in opposition are related to the close proximity of airports and the height of the plumes from this plant. The meeting on 7/21/08 will be from 6 to 8 pm and she encouraged residents to attend and to speak on this issue.

The Administrator noted that the street sweeper has been down for the past few weeks, due to a part that was unavailable. Also the water pump was stolen from the Association property in the past week, so we have to order a new pump to water up the sweeper. The sweeper will be out of commission for a total of 4 weeks.

6.0 OTHER BUSINESS (MOTIONS MAY BE REQUIRED)

6.1 Presentation by the Sheriff's Department on Marijuana Clincs (8 p.m.) - Officer Liskey -- Bieschke introduced the sheriffs' department regarding the issue. He stated that the Association did a survey earlier this year with its members and found that of those who responded, 68% were opposed to the way the marijuana clinics were being run currently in the unincorporated area. Bieschke stated that recently the Board of Supervisors (BOS) has had a discussion about taking this issue away from the sheriffs department and giving it to the health department.

Sheriff Amaral and Deputy Liskey noted that there has recently been a proposed study to replace the sheriff's department as the lead agency and give it to another department, such as the health department. There will be a 90 day study to review this proposal. The Sheriff's gave a presentation regarding Proposition 215, the medical marijuana issue and its impact on the community. Residents who spoke against the issue pointed out the affects on the communities in and around these clinics and the lack of information regarding these clinics. There are few statistics and little or no regulations regarding these clinics. Those in favor of the clinics noted health issues that require the legal use of the drug.

The Sheriff's Department was concerned in light of the new proposal by Supervisor Miley to look into another agency to handle these clinics. The Sheriff's noted an increase in incidents of crime, drug dealing and illicit activity, related to these dispensaries since Proposition 215. They said that the Proposition itself does not say one word about these dispensaries. The Sheriffs department pointed out that there is a constant need to monitor these clinics, not just for what they are dispensing, but to whom they are dispensing, the amount they are dispensing and the reason. There could be a huge impact to the communities in and around these areas if the Sheriff's department was no longer monitoring these businesses. The Sheriff has already written to the BOS stating that he does not believe these dispensaries need to be in our community.

The Board pointed out that the BOS promised the communities some restrictions on these businesses if they were to remain in the community. It is unclear that these restrictions are being met. Residents and community members need to ask their Supervisors for more restrictions on these dispensaries to protect residents.

The Sheriff pointed out that his department cannot ask for personal information regarding these clinics because these clinics are considered a "medical dispensary" and a have legal restrictions regarding giving out personal information.

The Administrator invited residents to come to the next unincorporated meeting where both Supervisor Lai-Bitker and Supervisor Miley will be present. Even if it is not on the agenda, residents can speak under Public Comment to the Supervisors at this time.

Deputy Liskey announced that the second reading on this ordinance will be held by the Board of Supervisors is this upcoming Tuesday in Oakland at 10:30 am. He noted that residents should attend that meeting to give public input.

6.2 Appointment to the Citizens for San Lorenzo School Committee -- President Bieschke noted that this will be a group looking into another bond for the school district. Director Martins was nominated to this committee and accepted the nomination.

6.3 Appointment to the Study Group for Marijuana Clinics -- President Bieschke was nominated to this study group and accepted the nomination.

Director Wright made a motion to appoint Director Martins to the Citizens for San Lorenzo School Committee and President Bieschke to the Study Group for the Marijuana Clinics, Director Pebelier seconds the motion carries unanimously.

7.0 COMMITTEE REPORTS

7.1 H.A.R.D. Advisory Committee meeting - Mel Medeiros -- Director Medeiros reported that there are only nine people on this board, but they can have eleven. We are expecting that a San Lorenzo appointment will happen in January 2009. He noted that there is a proposal for an extension of Measure AA which is an extension of the East Bay Regional Bond. This measure was passed in 1988 and this is an extension of that measure which will continue to provide funding for the district. He noted that any residents can attend these meetings where decisions are being made as to where funding for recreation in our area is directed.

7.2 Economic Development Committee Report -- Director Bieschke noted that there a copy of this report is in the Association office for anyone interested. The county is contracting out for a person to help promote businesses in our unincorporated area. One change that he noted is that a recommendation has been made to reappoint members to the committee, due to a lack of consistent membership.

7.3 Redevelopment Meeting -- Director Pebelier reported that there was a meeting July 9, 2008. The committee discussed the Lorenzo Theater status and will be approaching the owner to see if it will allow the friends of the theater to extend the process to raise money to purchase the theater. The previous agreement expired at the end of May 2008.

The committee also discussed the status of the Village Square. The owner Bohannon, has expressed an interest in developing the area himself. The committee was told that the Bohannon Corporation is discussing designs with architects and once they have drawings they will come back to the committee.

3. 15763 Paseo Largavista - Vehicle stored in driveway. Closing out, vehicle removed.
