SAN LORENZO VILLAGE HOMES ASSOCIATION
MEETING NO. 1110

July 21, 2005


The regular meeting of the San Lorenzo Village Homes Association Board of Directors was held Thursday, July 21, 2005.

1.1 CALL TO ORDER -- President Kathie Ready called the meeting to order at 7:41 p.m.

1.2 SALUTE TO THE FLAG - President Ready led the Board and the audience in the pledge of allegiance.

1.3 ROLL CALL - Directors Kathie Ready, Jim Sherman, Pat Pebelier, Peggy Sheridan and Director Patrick Ledesma were all present.

2.O MINUTES FROM THE PREVIOUS MEETING -- Director Sheridan moved Director Pebelier seconded the motion to approve the minutes from the June 16, 2005, meeting Number 1108. Director seconds the motion. The minutes are approved unanimously.

3.0 COMMENTS FROM PUBLIC AGENCIES

Resident Keith Barros stated that he heard that someone had identified the youth who had tagged Citibank and other areas recently with graffiti. Franco stated that if anyone has any information they need to call him and he will follow up on it.

Resident Steve Daly asked that the CHP ticket cars on Via Alamitos on the weekends because they are parking up on the sidewalk.

Director Ledesma asked that the CHP ticket a vehicle parked the wrong way on Hesperian near the vacant lot and Taco Bell.

Barros said there has been a car parked on Albion behind Kragen that has been abandoned and has two tickets on it.

3.3 Supervisor Alice Lai-Bitker -- Staff member, Kevin Dowling, reported that the San Lorenzo Post Office has met with the county regarding its relocation. It will be losing its lease with Bohannon by 2007. County Redevelopment has already offered them a retail space in San Lorenzo and another distribution center in the Hayward area. There will be a meeting in the upcoming week for San Lorenzo residents to voice their input into the post office's future. The meeting will be held in the Community Hall and the post office would be informing all its San Lorenzo customers about the date and time.

Dowling reported that the Waste Management recycling trucks are too tall for some of the "courts" in San Lorenzo, so they will be moving PGE and other utility lines.

He also reported that there will be no unincorporated services meeting in August.

Resident Barros stated that those large recycling trucks are not suppose to be servicing San Lorenzo in the first place. That was the Villages agreement so that we could put our cans on the curb and not in the street.

3.4 Zoning Enforcement Report -- See Attachment A.

3.5 Public Comment - Items Not on the Agenda

A Cherryland resident, Erica Campisis, said that she is in the process of gathering information and support for a parcel tax for additional law enforcement officers in the unincorporated area of Ashland, Cherryland and San Lorenzo. This will be a $50.00 parcel tax with a five year sunset. She will be gathering more information and will be talking to Supervisor Lai-Bitker, but wanted the residents ins San Lorenzo to be aware of what she was doing.

4.0 FINANCIAL REPORT

4.1 Approval of May, 2005 expenditures and discussion of significant variances -- The Administrator noted that the variances would be reported in the upcoming audit. She stated that eleven (11) liens were released since the last board meeting.

6.0 HEARINGS AND VARIANCE ISSUES

6.1 Hearing Dispositions

Revisit the following properties that were continued:
17345 Via Julia -- Status of stored vehicles. Refer to County and to attorney.
1836 Bockman -- Debris in driveway, planting and landscaping. Has improved. Give owner 1 month to finish landscaping and remove all debris.

b) 17413 Via Frances -- Lack of Gen. maintenance, stored vehicle and debris in driveway. 30-day extension then re-review. Owner trying to evict tenants.
c) 1476 Via Buena Vista -- Lack of Gen. Maint., stored vehicle, debris in driveway, holiday lights, jet skis. Refer to attorney.
d) 15872 Via Alamitos -- Cars parked on lawn. No more cars on lawn but if chronic violation reoccurs will immediately refer to attorney.

z) 16038 Via Pinale -- TALL LAWN. Violation cleared but vehicle in driveway potentially stored asking for registration within 15 days.

6.2 Variance

A) 17676 Via Valencia -- Large Fishing Boat stored in street. Boat is gone. No action.
B) 16168 Via Owen -- Fence height; 6.5 ft solid fence in back yard. Board approved 6 ft fencing and would not petition against resident if got approval from the county for the 6" variance.

Director Sheridan noted that at last month's Board meeting 15725 Via Cordoba was considered on the hearing list because of the paint color that was never approved. The Board wanted to see if in time the paint would fade. However, upon further review, the board noted that it has not faded. Thus, Director Sheridan made a motion, seconded by Director Pebelier for the owner to submit new paint plans within the next 45 days or they will be taking the owner to court.(Motion carried unanimously).

Director Ledesma made a motion to approve the Hearing and Variance issues. Director Pebelier seconded. The motion carried unanimously.

7.0 ADMINISTRATOR REPORT

7.1 Informational items -- The Administrator asked if there were any objections to KFC putting up illuminated awnings at their store on Hesperian . There were no objections. The Administrator reminded everyone about the upcoming 60th Anniversary celebration for the Homes Association. She invited everyone to participate on Saturday, September 10th. There will be a parade followed by community faire. More information will be given in the upcoming Homes Association newsletter.

8.0 OTHER BUSINESS

8.1 (7:45 PM) Presentation of Festival Cinema Center

Vic De Melo with Browman Development Company gave a presentation on the proposed development for the site where the now abandoned Festival Cinema building is. Their Company will actually purchase the property and develop it. They have already secured Target as a tenant which lost its lease its San Leandro location at Lewelling and Hesperian. They hope to get another well known company to add to the development. They currently own and manage over 2 million projects within their own company.

They have worked with a variety of projects in other areas of Hayward and have a good working relationship with the City of Hayward. Their landscaping in their projects is usually more than the city requires and is pedestrian friendly. De Melo noted that they received support from the Hayward Planning Commission last week and will be going before the Hayward City Council this coming week.

Director Ledesma asked how parking would be mitigated. De Melo stated that there would be 650 parking stalls in the main area. They would be adding 70 new parking stalls. He said that Target does its business all throughout the week, unlike the theater that had most of its business on the weekends. He stated that they would work with HARD to help mitigate any of these parking issues.

Resident Howard Beckman stated that he was concerned that the City of Hayward has fallen into a pattern of announcing a project [just] prior to its adoption. [The public] first heard about this project [one] week [before] a city Planning Commission meeting. He warned residents about being aware of the dangers of a city or any other organization providing public disclosure [for the first time just] prior to any meetings or adoption of a project. He was also concerned with the affect it may have on Kennedy Park. We already have very few parks in the area and Kennedy Park is one of those that has multiple features that attract a large number of people [from] outside our area. He is concerned that HARD was not made aware of this project prior to it going through the various channels for approval. Larry LePour, Director of Hayward Area Recreational District (HARD) noted his Board is in support of the development but had some concerns about how it would impact Kennedy Park which is across the street from the site. He said that HARD was not initially informed so that it could review the impacts the project would have on its park. He noted that Kennedy Parks busiest time is May through September, which does not necessarily coincide with Target's, however the loss of 300 parking spaces for "park patron overflow" may be a problem.

De Melo noted that his company is looking forward to working with HARD and has no intention of rushing through the project. All of HARD's concerns will be addressed.

8.2 (8:30 PM) Olson Company "Scoping Meeting" for the Bockman Project -- Motion

County staff person Steve Buckley reported that the project has been changed to allow 4500 square feet of commercial retail with 99 town homes. (See Attachments B, C, and D for outline of project, EIR and map.) He noted that the county is considering changing the zoning of this area to accommodate the development, however the preliminary EIR will take comments from residents and others regarding impacts that need to addressed.

Director Ready said she is concerned with the height of these town homes which is 10 feet higher (35 feet) than any second story home in San Lorenzo. How can the county allow 35 feet, when only 25 feet is allowed? The proposed high density of the area is also a concern. Ready noted that at one time the density proposed was between 15 to 17.4 units per acre-but this was only for the 700 block of Bockman. Now the proposed density for these town homes is 16.7 units per acre which is based on the fact the development will be in a "planned development" area or a PD. She said that type of density is too high-even for the Hesperian corridor. San Lorenzo is a single family home area, we do not have enough open space for the residence now. She was also concerned about the parking from this development "spilling out" onto Bockman and the feeder streets around the area. Parking is becoming a major issue in San Lorenzo, this development could exacerbate the situation even more.

The developer noted that the EIR will address the height, density and parking issues and whether the development should be considered a PD.

Director Ready also noted that the EIR addressed the schools where it showed that the surrounding elementary and middle schools are already at full capacity. We cannot expect the children of this development to be bussed to other schools that are already overflowing. She asked if Del Rey Park would be refurbished with the dedication fees the new development would bring. The Administrator pointed out that HARD would have to address that issue since it is their agency that receives the "park dedication fees" from developers. Larry LaPour from HARD stated that his agency would be responding to the EIR and would be willing to meet with the developer about a plan for Del Rey Park. He noted that the fees collected from this development would stay in the area. The Administrator questioned why these fees were given to other unincorporated areas when Centex Homes was developed five years ago in San Lorenzo. La Pour did not understand but assured her that the moneys for this development would go back into the San Lorenzo community.

Director Ledesma was concerned with the surrounding streets and how the traffic would flow in the area without creating potential traffic hazards and crowding driveways. He was also concerned that the height issue of this development be addressed.

Director Sherman was concerned with the 35 feet that would be towards the back of the property and would tower over and look into the adjacent yards of many of the existing homes in the area.

Many residents addressed a variety of concerns which included:

The density and the doubling of the amount of homes in an area and the impact this would cause for the narrow streets in and around Bockman to accommodate the traffic and emergency vehicles.

The impact parking on Bockman would create for the surrounding bus and school traffic.

The impact done to the streets and the sewer and surrounding pipes and plumbing with the construction vehicles traveling the roadways with heavy equipment and materials.

Resident and Airport Committee member, Ernie Delligati, noted that he has not heard anything about this from the manager of the Hayward Airport, Brent Shriner. He said that there is a safety issue with the air traffic in that area and the proposed 35 feet of these town homes. He encouraged the developer and/or the county to meet with the Airport to discuss these issues.

Buckley stated that the EIR would consider the compatibility with the neighbors vs. the new development.

The Administrator asked the Board whether it concurred with the comments brought forth at the meeting. The Board asked the Administrator to draft a letter based on the comments and to forward them onto the county and the developer.

Buckley noted that they will be accepting comments until August 8th for the EIR. They will have a public hearing at the county building on W. Winton on August 1, 2005 for a public review of the project. He said that the custom zoning for this site to become a PD would require home and land design which would be a "mega" variance.

Director Ready thanked the county and the developer for their presentation and for listening to all the concerns the community brought forth.

9.0 PUBLIC COMMENT

Resident Keith Barros asked what the status of the Village Square development was. He questioned when the developer, Civic Partners, was coming back to report to the Board. The Administrator noted that the developer is scheduled to speek before the Citizens Action Committee on August 9, 2005, but she will try to get them before that time to try and get an answer.

The Administrator suggested that the Economic and Development Committee invite Vic De Melo of Browman Development to speak about his companies progress in developing areas in Hayward and throughout the Bay Area. She noted that he may be able to give the community some insight on what it takes to make a development "successful".

Resident Ernie Delligati noted that he did not see "eminent domain" mentioned in the preliminary EIR. He just wanted to make residents aware of this and to be very cautious. Dowling noted that there has been some inaccurate reporting related to this issue and that the only way you can use eminent domain is through redevelopment and it must go through a very long public process prior to being approved.

10.0 COMMITTEE REPORTS

10.1 Airport Committee Update -- Airport representative Ernie Delligati reported on the upcoming Hayward Airport improvement projects that will affect some San Lorenzo homes from July 25, 2005 until the end of October. (See Attachment.) He also attended the Oakland Airport Noise Committee Meeting and said that patterns in Oakland have changed. He is working with Supervisor Lai-Bitker to make her aware of all the facts pertaining to this noise and the quality of life in San Lorenzo.

10.2 Library Committee Update -- No update.

11.0 COMMENTS FROM BOARD MEMBERS -- Director Sheridan thanked Keith Barros for his recent letter to the editor. Director Ready thanked all those residents who stayed until the end of the meeting.

12.0 ADJOURNMENT -- Director Ready adjourned the meeting at 10:07 p.m.
