SAN LORENZO VILLAGE HOMES ASSOCIATION
MEETING NO. 1039

July 20, 2000


The regular meeting of the San Lorenzo Village Homes Association Board of Directors was held Thursday, July 20, 2000, at 7:35 p.m. in the auditorium with President Dorothy Partridge presiding over the meeting.

1.1 CALL TO ORDER - President Dorothy Partridge called the meeting to order at 7:35 p.m.

1.2 SALUTE TO THE FLAG - President Dorothy Partridge led the Board and the audience in the pledge of allegiance.

1.3 ROLL CALL - Directors Jim Spears, Dorothy Partridge, Jim Sherman, Patricia Pebelier, were present, Director Sloan was absent.

2.0 MINUTES OF THE PREVIOUS MEETING -

2.1 Approval of Minutes of Meeting No. 1038, Thursday June, 2000 - Director Pebelier made motion to approve the minutes, with a second by Director Spears, the motion passed unanimously.

3.0 COMMENTS FROM PUBLIC AGENCIES -

3.l Alameda County Sheriff's Department - Deputy Lind reported that he had no crime statistics for the previous month. He said that his department is working on several things in San Lorenzo, one of which is a disturbance of neighbors on Via Buena Vista. He will be updating, the Association office regarding this as he finds out more information.

3.2 CHP Department - Greg Schmeck reported the CHP statistics for the month of June: there were 303 parking tickets issued for the unincorporated area, 60 of which were in San Lorenzo; 184 fix-it tickets; 844 moving violations of which 162 were issued for San Lorenzo. There were 119 traffic collisions in the entire unincorporated area, 38 which were in San Lorenzo; 63 DUI arrests and 112 vehicles which were towed or impounded, 22 which were located in San Lorenzo.

Officer Tuazon reported that his unit has been after vehicles Nvhich run red-lights on Hesperian Blvd. He stated that in one day his unit issued 22 tickets for that area. Tuazon said that County Traffic Engineer is going to have signs put up at major intersections which will warm how much the fine will be for vehicles which run red lights.

3.3 Supervisor Gail Steele - Alison Lewis, aid to Supervisor Steele, spoke on behalf on the Supervisor, who was unable to attend the meeting. She reported that the house on Washington and Grant, which is owned by the county, will be painted next week. She also reported that Supervisor Steele has been meeting with developers regarding the Village Square area.

4.0 PUBLIC COMMENT

It was announced that the Leacue of Women voters would be hosting, a luncheon/forum on the School Voucher Initiative.

5.0 FINANCIAL REPORT -

5.1 Approval of June 2000 Expenditures - Director Sherman moved with a second by Director Spears that the Board approve the expenditures for June. The motion was passed unanimously.

5.2 Discussion of Significant Variances - The Administrator said that there was an increase in cash due to Association fees being invested into bank CDs which are out of the area and are yielding higher interest rates.

6.0 LIEN AND VIOLATION REPORT - The Administrator reported that there were no liens released this month. There are currently 323 cases open.

Director Sherman made a motion to approve the Liens and Violation Report. Director Spears seconded the motion and it was passed unanimously.

7.0 BUSINESS DEVELOPMENT REPORT -

7.1 Business Development Reports - Ready reported that there were no appointments for the month of July. There was much discussion about redevelopment (see attached outline of meeting).

Ready questioned why the cargo containers at the Bockman Shopping Center were still stored behind this location. She stated that the committee had been informed that the Specific Plan would be finalized by the end of July. The committee had also talked about participating in a "Make a Difference Day" in San Lorenzo, however the day would be called "Clean up San Lorenzo Day".

7.2 Business Development Committee's motion(s) - Ready stated there were no motions to forward onto the Board at the Committee's July meeting.

8.0 ADMINISTRATOR'S REPORT

8.1 CC&R Review Committee - The Administrator had recommendations for the CC&R committee - see attached outline of recommendations.

The Administrator suggested a 9 (nine) member Ad-Hoc committee that would sunset once committee recommendations reaarding CC&R policies are made to the board. She stated that final selection of committee members would be made by the board and members would be solicited through the next Association newsletter.

Director Spears made a motion to approve the Administrator's recommendations for the formation, structure and process of the CC&R policy and review committee. Pebelier seconds, the motion passes unanimously.

8.2 Other informational items - The Administrator announced that a new voice mail system had been installed in the Association Office. Now residents can be updated about hall availability, street sweeping, and community meetings on a weekly basis. Residents can also access the office staff directly via their respective extensions.

President Partridge suggested that information recarding the new phone system be posted in the upcoming newsletter.

The Administrator announced that on August 7th the church groups use permit for the Lorenzo Theater would go before the Planning Commission. The Commission has requested an outline of how the group would be renovating the theater before it could take a vote on the issue of use by the church.

The Administrator also announced that she has been in contact with county zoning and they have received no plans as to the rezoning the commercial area at the end of Grant from "light" to "heavy" industrial. She will be forwarding a letter to the department questioning the status.

9.0 OTHER BUSINESS -

9.1 Utility User Tax - Michelle Fidelly from Alameda County reported that there is currently a 5.5 % users tax which is attached to gas and phone usage in the county. This tax is set to sunset 2001 and is up for renewal by initiative this November. She stated that this tax benefits unincorporated residents in the county by adding funding for the sheriff, libraries as well as community development. She pointed out that the State surplus has not been shared back with the local governments. The state initially took away 107 million per year from the county. This utility tax, if approved would raise 5.8 million dollars. Of this, 3.5 million would go to the Sheriff's Department, 2 million to libraries and 0.8 million to community development.

Undersheriff Watson spoke about the impact the Sheriff's Department would incur with the loss of this tax. This tax directly benefits law enforcement services. It helps fund more Sheriffs on the streets, the COP SHOP and the DARE program in schools. Watson stated that with this loss of 3.1 million per year there is a possibility that units would disappear (approximately 40 personnel).

County Librarian Linda Wood spoke about how the loss of these tax funds would affect libraries. She stated that the current benefits of this tax are loncer hours of service in San Lorenzo and Castro Valley Libraries. Staff size has been increased in these libraries and the Book Mobile which goes into schools, senior centers and child care centers is funded by this tax. In addition, materials and technical support services have been funded by this tax. Wood stated that should the libraries lose these funds services. would be reduced and all areas of library activities and material would be affected, especially children's resources.

Buzz Sorenson, Planning Director, from the Community Development Department, stated that these tax funds are used for Neighborhood Preservation and community preservation. A good example of the use of these funds is the Specific Plan which is being developed for the San Lorenzo Village Square.

It was questioned by resident Keith Barros as to how much money the tax payer is paying per month for this tax. Fidelly stated that it is approximately $7.70 per month. She stated that the Board of Supervisors could increase the tax and the sunset date along with increasing the funds to cell phone, interstate communication, and international communication. Cable service could also share some of these tax increments. Fidelly said she is speaking at community meetings in the unincorporated areas which will receive these funds to find out what the community wants. She noted that although all of Alameda County will vote on this tax, only the unincorporated communities will benefit. The tax must be approved by 51 % of the voters.

Fidelly asked for a show of hands from the homeowners in attendance what options they would like to see for another utility tax. A majority of the homeowners in attendance were against increasing the tax above its existing 5.5 %; against having the tax be extended to cable services, but in favor of extending the tax to cell, interstate, and international phone usage with a sunset for the tax set at eight years.

A motion was made by Sherman that the Board of Directors support the continuation of the utility tax, Spears seconds the motion. The motion passes unanimously.

A motion was made by Director Pebelier that the Board support the continuation of the 5.5% utility tax, and that this tax is extended to cell phones and interstate and international calls, with a sunset of eight years. Spears seconds the motion. The vote was as follows: For: Spears, Pebelier, Partridge. Against: Sherman. The motion passes.

The Administrator stated that she would write a letter to the Board of Supervisors to reflect the Board's position.

9.2 PG&E tree cutting policy - Karl Becker and Chris Hughs spoke about the tree trimming policies for PG&E. Becker stated that he is the inspector and an arborist who comes out and lines up and audits the work, as well as inspects the trees to see if the limbs are encroaching on PG&E lines. Hughs is the supervisor and stated that he would be willing to take any complaints that residents might have regardinc PG&E and its tree policies. He stated that the only lines that PG&E is concerned with are those that are at the very top of the poles. The other lines are the responsibility of the telephone company or cable company for the area. Hughs went on to state that PG&E will not trim the trees so that they are even, but is only concerned with trimming them away from the lines. He handed out pamphlets showing the type of trimming that they will do and noted that this type of trimming is standard and does not harm the trees.

Resident Kathie Ready stated that she was very upset with the way PG&E had cut her trees. Hughs offered to inspect the work that was done.

Resident Ron Groves stated that when Davy Tree was contracting with PG&E they trimmed his tree incorrectly causing it to drop more leaves. Groves had a professional arborist come out and re-trim his tree after PG&E had done the work. Hughs reiterated that PG&E is only required to do the work required and will not perform extra trimming for aesthetics if requested.

A resident asked if the lines leading from the telephone pole to the home are the responsibility of PG&E. Hughs stated that the service drop to a home is the homeowner's personal extension and his or her responsibility. It is the only line which is coated and can usually withstand vegetation which may or may not be encroaching on the line.

9.3 238 By-Pass EIR - Barb Fields reported that the final draft of the environmental impact report is out recarding the 238 by-pass. Ms. Fields reported that the by-pass will impact San Lorenzo as follows: motorists will need to get onto Mission and travel to Lewelling to connect with the bv-pass. The by-pass will end at Harder Rd. in Hayward and the only on and off ramp will be the A Street off ramp. It will affect seven (7) parks, nine (9) waterways and the Senior Center in Castro valley which will be in close proximity to this by-pass. It was further reported that there is no direct access to this by-pass from the tri-valley area. The only commuters to benefit would be those person who live in San Leandro and were traveling to Cal State Hayward. The final date for comment on the EIR is Juy 28, 2000. The consensus of the Board was to direct the Administrator to read this EIR and comment on it only as it relates to the San Lorenzo area.

Buzz Sorenson stated that county public works and zoning staff are working on a letter commenting on this EIR, he stated that the Administrator could add her comments to this if she chose to. He reported that the county would be presenting a report to the Castro Valley Municipal Advisory Council next Monday and invited the Administrator to attend.

10.0 COMMITTEE REPORTS -

10. 1 Youth Resources Committee - Director Partridge - Director Partridge announced that the Bohannon Orcanization donated $1000 to the Youth Resources Committee for a homework center at the San Lorenzo Library.

10.2 Airport Committee Reports - The Administrator reported that Howard Beckman had left a four page informational sheet recarding the update on the Hayward Airport. Copies would be available for the public in the Association Office.

10.3 Council on the Prevention of Drinking and Driving - Director Spears stated that there was no meeting this past month for the council. He will be representing the council at the Zucchini Festival next month.

11.0 PUBLIC COMMENT - Resident Keith Barros complimented Albertson's on taking care of a problem that he encountered at the store. He questioned the use of the Lorenzo Theater as a church by pointing out that four years ago the City of San Leandro was approached by a church group for use of the Bal Theater. The city turned down the use permit stating that the Specific Plan for the area did not allow a church in a commercially zoned area. Barros announced that the Lorenzo Theater Foundation would be holding one of its meetings at the San Lorenzo Conununity Hall on August 16 and invited all interested persons to attend.

12.0 COMMENTS FROM BOARD MEMBERS - None.

13.0 ADJOURNMENT - Director Partridge adjourned the meeting at 10:05 p.m.
