SAN LORENZO VILLAGE HOMES ASSOCIATION
MEETING NO. 1095

June 17, 2004


The regular meeting of the San Lorenzo Village Homes Association Board of Directors was held Thursday, June 17, 2004.

1.1 CALL TO ORDER -- President Kathie Ready called the meeting to order at 7:35 p.m.

1.2 SALUTE TO THE FLAG -- President Ready led the Board and the audience in the pledge of allegiance.

1.3 ROLL CALL -- Directors Kathie Ready, Jim Sherman, Pat Pebelier, Patrick Ledesma and Peggy Sheridan were present.

2.O MINUTES FROM THE PREVIOUS MEETING -- Director Sheridan moved to approve the minutes from the May 20, 2004, meetings Numbers 1094. Director Pebelier seconds the motion. The minutes are approved unanimously.

3.0 COMMENTS FROM PUBLIC AGENCIES

3.1 Alameda County Sheriffs Dept. -- Jerry Finton gave statistics for the past month:

Deputy Finton reported that the flea market this past month was the most successful that they have had. He also reported that 53 people graduated from their most recent citizen's academy. The Sheriff's Department also has a new unit called the DUI/Traffic Unit. Finton said one of the deputies gave out 30-35 stop sign tickets and numerous illegal parking tickets on Via Alamitos. His department is referring the parking and traffic problems to this unit.

Director Pebelier stated that a neighbor on Paseo Largavista had her back window shot out . She asked if any other incidents like this have been reported in the area. Finton did not know of any other incidents.

Resident Steve Daly thanked the Sheriffs for their enforcement on Via Alamitos. Another resident thanked them for their enforcement of the stop sign on the corner of Via Granada and Via Toledo.

Resident Keith Barros know if anything was being done to the individuals who are putting stickers on on street signs in the area. Finton stated that this is a problem with the schools being out for the summer. The sheriffs' patrols are keeping their eyes open for this type of graffiti/vandalism.

Director Ready said that there was a sign for the Cop Shop that was up on the chain link fence. She said that the sign was not appropriate in the way that it looked or where it was placed. There was no indication that it was a Cop Shop event. She said that the Association has been fighting signs that get hung up on that particular fence (without approval) for some time. Staff did alter the sign and place it in a more appropriate place but she asked that the sheriff's show the Association any signs in the future. Finton agreed that in the future they would bring the sign by the office for approval.

Barros asked that the CHP or the sheriffs look into a trailer parked in the Mervyns parking lot. He noted that there are people living in it. The Sheriffs stated that they would look into it and have it removed. Director Ready thanked the CHP for getting the big rig trailer to move out of the Mervyns parking lot area.

3.3 Supervisor Alice Lai-Bitker -- Staff member, Kevin Dowling, reported about the County's new shopping cart ordinance. They have investigated how the San Leandro ordinance worked for that city and will have an update on the status of this ordinance in the near future. He also reported that they will have representation from his office at the Alameda County Fair. His office is also looking into ways that residents can participate in non-firework activity for the 4th of July. Dowling reported that at the upcoming unincorporated meeting they will be discussing park dedication fees, the rent ordinance and other items. The Administrator asked that billboards be discussed at one of the next meetings. She was concerned with the status of the billboards in the unincorporated area of the county. She thought that redevelopment was dealing with this issue. Dowling stated that he will mention this to the redevelopment staff` and get more information.

3.4 Public Comment - Items not on the Agenda

Resident Lois Roach asked if the CC&Rs can be changed if the majority of a tract agrees to change something. The Administrator responded by saying if 75% of a tract agrees to change a CC&R it can be done. All the tract information can be obtained by the Association office.

Resident Nancy Shelvy asked if staff could investigate the house on La Palmoa and Nielson where the weeds have gotten excessively high in the front and rear yards.

4.0 FINANCIAL REPORT

4.1 Approval of May 2004 Expenditures and discussion of significant variances -- The Administrator stated that this is the end of the fiscal year and she will discuss variances at next month's board meeting. No liens have been released since the last meeting. Director Sherman moved to approved the May 2004 expenditures including payroll, with a second from Director Ledesma. The motion was approved unanimously.

5.0 LIEN AND VIOLATION REPORT - The Administrator reported that there have no liens.

6.0 ZONING AND VARIANCE ISSUES

6.1 Lisa Lo Hesperian Shopping Center Update -- The Administrator reported Auto Zone did withdraw its application but was convinced to stay. They had wanted to paint their own colors on the outside of the building, but Daryl Gray convinced them to stay with what was agreed upon by the Homes Association and the owner Ms. Lo. The colors chosen would be a buff base with a terra cotta red trim.

6.2 Variances from the Work Session

A. 16116 Via Primero -- side vinyl white fencing (continued from May work session). Owner showed material to board; they have continued this issue until next month to see how it will look cut. The fencing must be cut to fit with the plans submitted.

B. 16020 Paseo Largavista -- First and second story plans. Continued; no plans approved by the county yet.

C. 16038 Via Nueva -- Corner lot with 6 ft fence and a setback of 10 feet from the street. Approved with the condition that it does not block driveway. Administrator to do a site visit on Friday 6/18/04.

D. 1594 Via Amigos -- Deck/covered pation in back yard (already approved by the county). Approved, all setbacks are within CC&Rs.

E. 1627 Via Sarita -- Entire back yard covered with a canopy (no plans). Denied.

F. 15763 Via Lunado -- Swings and play structures stored in front yard. Denied.

G. 16173 Via Pinale -- Condition of front yard. Owner will be asked to remove a lot of the items in her front yard area. Administrator to do a site visit and speak with owner.

8.0 ADMINISTRATOR'S REPORT

7.1 Informational Items -- The Administrator stated that on June 28th or 29th there will be a meeting with County Traffic Engineer, Bob Preston and the Supervisor staff with residents in and around Via Rodriquez and Via Primero about the traffic problem in that area. The neighbors will have ample time to discuss the issue and look at alternatives to mitigate the problems.

The Administrator noted that on June 30, 2004 there will be a public meeting for anyone who is concerned about county planning or zoning issues. She also noted that the discount fair tickets should be in the Association Office soon.

The Administrator recently received an e-mail from Airport Appliance about their business sign. Airport Appliance wants to upgrade the sign with new paint etc. The Board discussed the sign and had concurrence that the sign should be lowered if possible and have better maintenance. The sign as it is now is not very attractive and is too high for the surrounding community in the area. The Administrator stated that she would contact redevelopment to get dimensions and the specifics on the sign.

8.0 OTHER BUSINESS

8.1 Lorenzo Theater Grant Application -- Representative Nancy Shelvy, from the Lorenzo Theater Foundation, asked the Homes Association for a reference letter to help with the Foundation's Grant application. She said that they are applying for a grant under the Northern County Community Loan Program in San Francisco. This Loan Program was just awarded 3 million dollars from Hewlett Packard, Organization and is to be used toward theater projects like the Lorenzo. The money can be used to ask for acquisition funds and start up fees for the Lorenzo Theater. Part of the application process asks that several organizations send reference letters on behalf of the organization's grant request and that is why she is asking the Association Board for a letter. Director Ready is concerned with how the Lorenzo Theater Foundation has any clout in requesting a grant for a building they do not own. Shelvy stated that a letter of inquiry about the grant will get the foundation "in the front door" so they can be considered as one of the recipients. She noted that the owner has agreed to let them lease the theater for 3 months and he said that he is amenable to the Deputy Sheriffs Association purchasing the building. Director Ledesma asked if would be possible for the owner to get a letter of support for the foundations grant request. Shelvy stated that it is possible to get an agreement from him. She will ask the Lorenzo Foundation's Board at its next meeting.

Dowling noted that Supervisor Lai Bitkers' office is willing to write a letter of support. Director Sherman makes a motion to write a letter in support of the Lorenzo Theater's grant application. Director Ledesma seconds, the motion carries unanimously. The motion carries unanimously.

8.2 New Oro Loma Proposal -- The Administrator reported that she and Director Ready have met with the Oro Loma Board on three (3) different occasions to deal with the ongoing problems of where the waste and recycling cans are being left for pick up. Due to the conflicting information from Waste Management, Oro Loma and the Homes Association, many residents are confused as to where they should put these cans for pick up. The original agreement was to have San Lorenzo exempt from the new recycling policy where cans are left in the street. But that the garbage men/women would leave the cans where they found them. Now the manager of Oro Loma, Mike Cameron, is saying that the waste and green cans can be exempt, but that San Lorenzo residents must put the recycling cans in the street. The Administrator brought this item back to the board for another discussion and possible action.

Director Ready stated that she was very disappointed with Oro Loma's response to their complaints. She has found documentation from District Manager for Alameda County, Robert Angel, that outlines that Waste Management will return carts to driveways in San Lorenzo. She has also found information about fines related to cans left in the sidewalk or in driveways impeding pedestrian traffic.

The Administrator stated that she has told Oro Loma if any cans are going to be left in the street they will have to change their Friday pick up that conflicts with the Association's street sweeping schedule. At the last meeting Oro Loma made it clear that it does not want to have recycling cans put at the curb, but wants to have them left in the gutter as it is now doing in other communities.

Director Ledesma makes a motion to maintain San Lorenzo's exemption for waste pick up, that all San Lorenzo Waste and recycling cans are to be picked up behind the sidewalk and returned to the same location. In addition, more information about this exemption should be distributed to all San Lorenzo residents for further clarification. Director Pebelier seconds, the motion carries unanimously.

Director Ready added that resident Howard Beckman could not be at the meeting tonight, but did send a fax which stated that the streets in San Lorenzo are narrow and that the Association Board should demand that Oro Loma abide by the original agreement it had with San Lorenzo. She also noted that Waste Management has had to bring back its original recycling trucks due to so many injuries from the other trucks.

9.0 PUBLIC COMMENT

Resident Mrs. Moser of Via Sonata has a problem with the Board's approval of her neighbor's plan for a second driveway to park his motor home. She stated that the side fence is on her property and so the cement should not go up to the edge of the fence. She was advised to get a surveyor, which she intends to do. She was concerned with the motor home being stored there. She was told that it is considered "stored" if it is parked there for more than 36 hours in the driveway. She is also concerned about the size of the motor home and the idea that it will be carrying propene and human waste and will be only 5 feet from her property.

Director Ready stated that the Board looked at the plans very carefully as related to the CC&R restrictions and the county neighborhood preservation ordinance. These restrictions do not cover the problems that Ms. Moser is concerned with. A resident cannot pave more than 50% of his or her driveway. Mr. Perez is not paving more than 50% of his front property and as long as he moves his driveway every 36 hours he is in compliance with the CC&Rs. The Administrator stated that she will review the approval letter again and go over it with Mrs. Mosher. Mr. Perez will be asked to take his patio furniture out of the driveway as this is against the CC&R's and the County Neighborhood Preservation Ordinance. She also suggested that Eden Mediation Services get involved to help resolve some of Mr. Perez's and Mrs. Mosher's conflicts.

Nancy Shelvy announced that in October of this year the Theater Foundation will have a Craft Fair and a tour of the Theater to raise funds for its Foundation.

Director Ledesma announced that some residents have formed a "Mommy Patrol" that meets weekly to walk the neighborhoods. He suggested that something be put in the Association newsletter about this.

10.0 COMMITTEE REPORTS

10.1 Airport Committees -- No report.

10.2 Library Committee -- No report.

11.0 COMMENTS FROM BOARD MEMBERS

Director Ledesma reported that as many as 22 technician positions and other positions will be cut at the Sheriffs' office due to county budget cuts. He urged residents to attend the county budget meetings and give their input.

Director Sherman asked whether the San Lorenzo Rotary was to come back to the board prior to its Wine and Flower festival. He said that Dr. Sanchez noted that the man who organized the Zucchini Festival was running the Wine and Flower Festival and that he would come and give an update about the specifics of the Festival as they relate to parking, security and other concerns. The Administrator stated that she will contact Dr. Sanchez and have a written report to the Board members within 72 hours.

12.0 ADJOURNMENT -- President Ready adjourned the meeting at 10:02 p.m.
