SAN LORENZO VILLAGE HOMES ASSOCIATION
MEETING NO. 1094

May 20, 2004


The regular meeting of the San Lorenzo Village Homes Association Board of Directors was held Thursday, May 20, 2004.

1.1 CALL TO ORDER -- President Kathie Ready called the meeting to order at 7:32 p.m.

1.2 SALUTE TO THE FLAG -- President Ready led the Board and the audience in the pledge of allegiance.

1.3 ROLL CALL -- Directors Kathie Ready, Jim Sherman, Pat Pebelier, Patrick Ledesma and Peggy Sheridan were present.

2.O MINUTES FROM THE PREVIOUS MEETING -- Director Sherman moved to approve the minutes from the April 15, 2004, meeting Number 1093. Director Sheridan seconds the motion. The minutes are approved unanimously.

3.0 COMMENTS FROM PUBLIC AGENCIES

3.1 Alameda County Sheriffs Dept. -- Deputy Jerry Finton gave statistics for the past month:

Finton announced that the Cop Shop would be holding its annual flea market on June 13, 2004. Spaces are still available.

Finton also announced that his department is trying to deal with the truck that is parking illegally on Via Arriba.

The Administrator commended the Sheriff's department for its quick response when a child came up missing at a local school. She was very impressed with how they brought together a command post in the hall and the amount of equipment and personnel who came together.

3.2 CHP -- The CHP stated that the area statistics were not broken down this past month. They will have them at a future meeting.

Total Warnings for Hayward Area CHP:  2,563
Residents brought up the problem with parking on Via Alamitos and asked that the officers continue their patrol and enforcement on that street.

3.3 Supervisor Alice Lai-Bitker -- Staff member, Kevin Dowling, thanked everyone for participating in the earth clean up day last month. There were over 150 people who participated. He also announced that the fireworks committee sponsored a poster contest with the children in San Lorenzo. There were three winners and the Supervisor honored each of them.

3.4 Public Comment - Items not on the Agenda -- Resident Tom Murphy on Via Alamitos was concerned about his property and the way that it has flooded on multiple occasions in the winter. He presented a letter to the Board which outlined his concerns and he noted to the Board that he had over 30 people who were also concerned. He said that the county has been contacted but he has not gotten much response.

Director Ready noted that the Board could not discuss this issue this evening due to the many agenda items that it needed to get to. She stated that the Board will definitely look into this and will get in touch with the people Mr Murphy had already contacted at the county to see what is or could be done. She suggested that the issue then be brought back to the Board within a 2 (two) month period. There were no objections from the Board.

Murphy pointed out that with plans for a new development at the other end of Paseo Grande, the issue with flooding, the sewer lines and the problems with run off would be worse. The Administrator noted that she would discuss this issue with the county and get some answers for Mr. Murphy.

Kevin Dowling noted that Supervisor Lai Bitker's office has had 2 (two) meetings with Mr. Murphy and he agreed that the roads and the run off for that area were poorly planned. At the time the streets and housing was designed there were not the traffic issues or problems there are today. Dowling notes that to fix that area would be very expensive and the county does not have the funds to do this at this time.

Resident Keith Barros announced that this Saturday there would be a fund-raiser dance held by the Lorenzo Theater Foundation. The event would be held from 7 p.m. to midnight at the Hayward Airport. All proceeds would go towards the Lorenzo Theater Foundation. Barros invited everyone to attend.

4.0 FINANCIAL REPORT

4.1 Approval of April 2004 Expenditures and discussion of significant variances -- The Administrator stated that the only significant variance was related to insurance costs which were due to adding an additional employee onto one of the plans. Director Sherman moved to approved the April 2004 expenditures including payroll, with a second from Director Pebelier. The motion was approved unanimously.

5.0 LIEN AND VIOLATION REPORT -- The Administrator reported that there have been 3 liens released since the last Board meeting.

Residents from Via Pinale noted that they were unhappy that they received a letter about their son playing drums when there are several houses on their street that have ongoing violations. The Administrator noted that staff is aware of the concerns on Via Pinale and is trying to do something about it, including sending at least two of those residences to the attorney. She stated that we normally send one (1) nuisance letter if someone complains about noise such as drums, but will not follow up unless several complaints come from several neighbors and it is noise that goes late into the night or early morning.

6.0 ZONING AND VARIANCE ISSUES

6.1 Lisa Lo -- Hesperian Shopping Center

Representative for Lisa Lo, Gordon Yee presented architectural drawings and the paint for the Lorenzo Manor Shopping Center. Director Ready noted that the drawings did not fit with the architecture that is already present at the center. She said the Board would like to see a new canopy and wanted the tubing on the old Wherehouse structure to be removed and brick work to be incorporated in the structure. She noted that the Board had approved painting three years ago and has waited since that time for some improvements to happen. Landscaping in the shopping center needs to be addressed so that the center can add to the residential area around it. She also suggested that the sidewalks be steam cleaned. Director Sheridan agreed that plans need to be submitted that reflect what the board originally agreed to. She asked that Ms. Lo produce some plans that show no sign of the old gridding that the Wherehouse had on its facade. Director Ledesma asked that the owner revise the landscaping in the plans and show that all grid work will be removed prior to the new owner occupying the building.

Yee stated that he and his client would talk with Auto zone about these suggestions. Dowling suggested that the owner needs to comply with what was originally agreed upon and to listen to the community, so that his office does not have to get involved further.

Ms. Lo asked if she could give Auto Zone authority to move in with an agreement that these changes would be made. The Administrator said that first the owner needs to give the Board the new plans and the paint colors, prior to any new tenancy. She noted that the owner promised to make these changes when the old tenant moved out 3 months ago, and they have not been done. Ready noted that Auto Zone's tenancy was already approved by the Board. The Association wants to ensure that changes which were previously agreed upon for facade, landscaping and paint color are adhered to prior to the tenant moving into the facility.

County staff member Daryl Gray assured the Board that he would work with the owner and Mr. Yee in getting these improvements in writing prior to any occupancy or agreement from the county for the occupancy.

6.2 Variances approved/disapproved at the work session

Director Ready reported on the following variances in tonight's work session:

A) 15724 Via Sonata -- Landscaping/cement. The Administrator noted that this issue will be carried over for a few days. The Board needs to calculate the exact footage of landscaping versus concrete and will make a decision based on this and the restrictions outlined in the CC&R.

Resident and neighbor to this property, Mrs. Mosher questioned whether the Association has a licensed surveyor. Who is liable if the measurements are not right. The Administrator assured Mrs. Mosher that if the measurements are close within an inch or two the plans would not be approved. The Board's policy is no more than 50% of the front part of the property Mrs. Mosher stated that this owner wants more pavement to park his motor home in one area near her house. She questioned whether this was legal according to the CC&Rs. The Administrator noted that as long as he does not store it there it will be okay. She has informed the owner that he must move it every 36 hours. Mosher wanted to know how this will be monitored. The Administrator noted that staff will do its best to monitor the situation, but that the neighbors need to make the Association aware of this storage if it is happening as well. Director Ready assured Mrs. Mosher that staff would do all it can to monitor this situation.

B) 17201 Via Del Rey -- 3 ft white wrought iron fence around the property. Approved with stipulation that it is no more than 3 ft in height and that the wrought iron has no sharp points at any end of the fence posting.

C) 16122 Via Andeta -- Exterior paint that was to be repainted by this Spring. Board denied paint color again and directed staff to get attorney involved.

D) 16116 Via Primero -- Front fence step fence, white vinyl to separate both sides of front of property. To be continued. Board wants to look at the fencing and review how it will be cut.

E) 16020 Paseo Largavista -- Second story addition. Continued; no plans submitted.

F) 16066 Via Primero -- Back yard shed 10 by 16 (15 ft actually) with peak no higher than 10 ft and sides no higher than 8 ft (3 ft setback from fence). Approved, even though size was greater than what policy reflects, due to larger lot size.

G) 16117 Via Milos -- Enclose patio. Denied because of setbacks and continued until Board can review again and discuss with the county.

H) 17017 Via Pasatiempo -- Trailer to be stored in additional driveway. Denied. I) 17401 Via La Jolla -- Driveway widening. Continued; Board to review and measure lot to make sure not more than 50%.

J) 985 Via Honda -- driveway widening. Continued; Board will go out and measure and review.

7.0 ADMINISTRATOR'S REPORT

7.1 Santa Fe catering variance withdrawn by applicant -- The Administrator stated there was no report due to the applicant withdrawing their plans.

7.2 Update of AC Transit bus stop -- The Administrator noted that a meeting was held with AC Transit, Supervisor Lai Bitker's office, Bob Preston, Traffic Engineer and the resident Liz Thayer. The meeting concluded that the bus stop could not be replaced even it was done across the street. The sidewalk in front of Ms. Thayer's residence was wider for handicapped and passengers loading and unloading. There also is a requirement about how many feet there must be between each bus stop, therefore it could not be moved further down the street. Dowling stated that he would get in touch with the schools whose students are utilizing this bus stop and if needed that the sheriffs get involved in patrolling the area during after school hours.

8.0 OTHER BUSINESS

8.1 SLZ Rotary Wine Festival - Dr Sanchez -- Dr. Sanchez announced that on July 17 and 18th the Rotary would be holding it's third annual Flower and Wine Festival in San Lorenzo Mervyn Morris Park. He said that the have help from an individual who runs the Zucchini Festival every year. They have also lowered prices for vendors to $150. He invited all to attend. Director Sherman wanted assurance that the school district is on board with the parking and that all the property authorities have been contacted regarding this event. He asked that Sanchez come back to another meeting in June to assure the board that all these issues had been addressed.

Sanchez also handed out flyers for a celebration in May called "We are the World". He noted that it will be a multi-cultural event held at the Marina Community center and Alice Lai Bitker will be in attendance.

The Administrator thanked Sanchez and the Rotary for its support in the Association's Cancer/Aids fund- raising events.

8.2 Garage Conversions -- The Administrator said that the issue of garage conversions will be taken up next week at the Zoning meeting at the county. President Ready indicated we expect to approve a final version very shortly.

9.0 PUBLIC COMMENT -- None.

10.0 COMMITTEE REPORTS

10.1 Airport Committees -- Ernie Delligatti stated that he had no report. He did note that he has been working with the FAA at the Oakland and Hayward airports regarding the number of flights over San Lorenzo. He said that residents may notice fewer flights over our area. Director Ledesma stated that he has noticed an increase in helicopter flights. He spoke with the manager at the Hayward Airport and he is working on the noise abatement issue.

10.2 Library Committee -- Director Pebelier noted that at the last meeting both Supervisor Lai Bitker and Supervisor Miley were in attendance and were discussing changing the structure of the Library Committee. They will be discussing this at the next meeting.

11.0 COMMENTS FROM BOARD MEMBERS -- The Board thanked all who attended. Director Ready encouraged people to come to the meeting regarding the Specific Plan on May 24, 2004. She stated that the plan is in the process of being finalized. Civic Partners has hired a firm to test the soil in Village Square area. The first phase of the project will be to move Albertsons into that area.

Director Ready assured residents that the Board and staff are doing what they can to enforce the CC&Rs. She asked that those who came tonight for the first time to come back again and bring up issues of concern. The Association Board wants to hear neighborhood concerns and issues . Sheridan said that the Board members want to better San Lorenzo and encouraged residents to let them know when they feel something is not being taken care of.

Director Ledesma reported that he attended an EBMUD meeting where they discussed the East Bay Groundwater Project. There was nothing new to report. They will have preliminary results on the survey they performed.

12.0 ADJOURNMENT -- Director Ready adjourned the meeting at 9:45 p.m.
