SAN LORENZO VILLAGE HOMES ASSOCIATION
REGULAR MEETING NO. 1147

April 19, 2007


The regular meeting of the San Lorenzo Village Homes Association Board of Directors was held Thursday, April 19, 2007.

1.1 CALL TO ORDER -- President Wulf Bieschke called the meeting to order at 7:38 pm.

1.2 SALUTE TO THE FLAG -- President Bieschke led the Board and the audience in the pledge of allegiance.

1.3 ROLL CALL -- Directors Wulf Bieschke, Jim Sherman, Pat Pebelier, and Margaret Wright were present, Kathy Martins was absent.

2.O MINUTES FROM THE PREVIOUS MEETING -- Approval of meeting number 1145, 1142, 1143 and 1144. Pebelier makes a motion, Wright seconded. Motion carries. The minutes are approved unanimously.

3.0 COMMENTS FROM PUBLIC AGENCIES

3.1 CHP Report -- Deputy Hahn gave the following statistics:

Officer Hahn noted that he would be leaving San Lorenzo patrol for another unit, and he wished to convey that he enjoyed working with the community and the board. Officer Rob Tuazon would be replacing Hahn.

3.2 Alameda County Sheriff's Dept. -- Deputy Liskey reported the following statistics for the past two months [see minutes of the March meeting for preceding month's statistics]:

Liskey noted that there was only one report of vandalism/graffiti and he has seen much more graffiti than has been reported. He asked that residents contact him when they see graffiti or report it to the non-emergency number at 510-667-7721.

Liskey also spoke about the recent bank card fraud that happened to many San Lorenzo residents. The authorities had found that the San Lorenzo Albertsons was involved through their check card machines which had been tampered with. He encouraged residents to change their pin numbers and card numbers.

Liskey said the store's new management under SAVEMART acted very quickly in changing out all of their machines so that they cannot be tampered with again. He encouraged residents to shop at Albertson's, noting that this type of fraud could happen anywhere. He said that residents should be paying attention to their bank accounts and credit card statements at all times to catch any non authorized charges or withdrawls. There will be a meeting with Senator Mary Hayashi about identity theft this coming weekend and he encouraged residents to attend.

Liskey stated that there was a robbery today that closed down several streets in San Lorenzo, near Via Del Rey and Via Coralla. The sheriffs were chasing a suspect on foot, and believe that he lives in the area. He was not apprehended and is still at large.

Liskey noted that on June 9, 2007 in the Mervyns parking lot, the Cop Shop will host its Annual Flea Market. For more information contact the Cop Shop at 510-667-7770. He also reported that the four new technicians wrote over 2000 tickets thus far and towed over 140 cars.

8.1 H.A.R.D. (Hayward Area Recreational District) presentation on Community Advisory Committee (Timed agenda item at 7:45 pm)

HARD representative, John Gouveia, gave a brief history of the Hayward Area Recreational District. He noted how the agency has its own elected board and holds monthly meetings. HARD has a history of working with community groups to provide recreational facilities and activities to the community. They have formed several ad hoc committees for different communities when issues related to recreation or their facilities come up that need more community input. Gouveia noted that he was present at this Board meeting to see if there were any needs in San Lorenzo that were not being addressed. He also stated that if the San Lorenzo community wanted to form an advisory committee or an ad hoc committee, he would take it back to his board.

The Board of Directors all agreed that they would only support a committee if there was a need. They did not see any needs at this time. They appreciated Mr. Gouveia, and HARD's interest in San Lorenzo and encouraged him to come back to the meetings more regularly, so that the community can be informed on HARD issues.

The Administrator said that several months ago, there was an extensive survey asking residents what they thought about HARD's services. What happened to the results of this survey? Gouveia noted that the results were part of HARD's master plan update and they are in the plan and available on line.

Director Sherman asked about the status of the property behind Edendale and Bohannon and partnering with the school district to create gyms. Gouveia noted that the property behind Edendale once housed oil and gasoline and is considered a "brown filed". HARD is trying to settle on a price that will also clean up the land prior to building on it. He had no other information on the Bohannon site.

3.3 Supervisor Alice Lai-Bitker -- Staff member, Kevin Dowling said that the county received funds from Proposition 63 which was a mental health taxed that passed several years ago. The county is hiring an agency that will deal with issues of homelessness. He noted that his office will be looking at the Duck Park area in San Lorenzo and behind that park, where there are some homeless encampments.

Dowling stated that his office has been working with Supervisor Steele's office to secure a site for a BMX bike trail. They have come into some difficulties with securing a site near the wetlands at the end of Grant and are now looking at a site behind the San Lorenzo Adult school. He should have more to report on this later.

Dowling reported that the Social Host Ordinance was discussed recently at the Castro Valley MAC (Municipal Advisory Council). This council had suggested adding "drugs" along with alcohol to this ordinance. It was pointed out that drugs are already illegal, so it would not be necessary to add them in. Anyone caught using drugs could be prosecuted already whether at a party or for individual use. The Social Host ordinance would allow an officer to investigate a party if it is loud and unruly. They could then prosecute any underage drinking. He noted that this ordinance was only for residences and not businesses. The Board of Supervisors would be discussing this in May 2007.

3.4 Zoning Enforcement Report -- See Attachment A for monthly report.

3.5 Public Comment -- Resident Keith Barros was concerned about the speed on rural roads. He noted that the speed on several Castro Valley streets is being changed. State Senator Ellen Corbet introducing a bill SB848 that would help to change these speed limits. He wanted to go on record in support of this bill.

Resident Margos Gallos, stated that she is concerned about her neighborhood and our community. She would like to see a neighborhood watch group on every corner. She is also in support of one more sheriff officer specifically for the San Lorenzo Village area. She noted that she has done some investigation and it would cost approximately $225,000.00 per year. She asked that a committee be formed to assess this idea to see if we could raise funds to secure this officer.

Another resident, Thomas Love, who works in the paramedic field for Alameda County, stated that even if we secured the funds, the officer could not be guaranteed only for our area. Officers are often called to different sectors to help out or assist their department or other departments.

Resident Kathie Ready suggested that San Lorenzo consider a CSA (Community Service Area) through the county to support this idea of additional law enforcement for our area.

The Administrator asked President Bieschke to discuss this in his next neighborhood watch meetings to see if the residents would support the idea.

4.0 FINANCIAL REPORT

4.1 Approval of March 2007 expenditures, including payroll, and discussion of significant variances -- The Administrator reported there were no significant variances for the past month. Director Sherman moves to approve the March 2007 expenditures, including payroll, Director Pebelier seconds, the motion carries unanimously.

5.0 LIENS AND VIOLATIONS REPORTS -- The Administrator reported there have been 6 liens released since the er Board meeting.

6.2 Variances

1. 16116 Via Conejo - Deck addition that is 12 inches to fence. Approved with 5 ft setback.
2. 17152 Via Corona - 700 sf separate "office" addition in back yard. Denied.
3. 1569 Via Escondido - Second Story addition. At least two neighbor objections, will discuss with owner and neighbors options; not approved currently as submitted. 4. 1618 Via Ventana - Back yard shed 10 x 12 with variance for set back of 3 feet. Approved.
5. 17024 Via Media - Owner petitioning for more than 50% concrete at front of property. Denied.
6. 1829 Bockman - Side fence to be replaced at 6 ft off leading edge of house; already 6 ft due to enclosure of neighbor's back yard (corner lot abutting normal lot); owner to take out smaller 3 ft fencing with over 10 ft set back from street. Approved due to lot configuration.
7. 27 Via Diego - Variance for tuf shed 10x12 with 3 ft setback. Approved.
8. 1414 Via Vista - Approval of pavers already installed. Staff to make site visit and owner to not park over lawn area; site visit to determine concrete to grass/landscaping ratio.
9. 16150 Via Catherine - Variance for sun room to be installed at front of property. Denied as submitted; owner asked to come back with additional plans.

7.0 ADMINISTRATORS REPORT

7.1 Informational Items -- The Administrator announced that the Eden Area General Plan will be discussed at the next Unincorporated meeting May 9, 2007 in the Association's Community Hall, she stated that this is a very important issue and encouraged residents to attend.

The Administrator asked President Bieschke to report on the meeting that they had earlier today with the representatives from SAVEMART, (The company that recently bought the Albertsons chain).

President Bieschke reported that he, the Administrator and staff from Supervisor Lai Bitker's office met with the Vice President of Real Estate for SAVEMART earlier today. They toured one of the markets and were all very impressed. The store was open and clean.

SAVEMART is a family owned business and is interested in quality according to its employees. Albertson's was acquired by SAVEMART in February 2007 and Civic Partners was asked by the Association Board to have the new company make a decision as to whether it wanted a new store in the Village Square area within 90 days of this closing. President Bieschke noted that SAVEMART appears very interested and would be sending a "letter of intent" within 90 days. This letter would in fact be a contract to do business. There are just a few issues that area holding them up right now.

SAVEMART wants a certain number of parking spaces and they want to be sure that the financial numbers are in their favor. SAVEMART is a union store and their Vice President stated that if they moved they would close the store for one day and move to open the new store the very next day, with minimal impact to the community.

President Bieschke noted that Supervisor Lai Bitker stated that she would do whatever it takes to get this project moving. SAVEMART representatives noted that once the contract is in place they would be breaking ground within 8 to 18 months. They are also considering changing their name to "Lucky" at least at the Northern California sites.

7.2 Update Oro Loma Garbage Can Stickers -- The Administrator noted that she would have the stickers ordered within the next month.

8.0 OTHER BUSINESS

8.1 H.A.R.D. presentation on Community Advisory Committee (7:45 pm)** See above notes.

8.2 Preliminary Discussion of a paint color policy -- The Administrator had contacted the Association's attorney and the only suggestion he had was a color pallet that the Board approve. The Directors have varying opinions about this and the Association has never followed "one color" pallet. The Administrator noted that the Board would be discussing this further and she will report back at another meeting. 8.3 Discussion of a clean-up program for San Lorenzo -- The Administrator noted that at the last town hall meeting a few residents had wanted to help "clean up" the community on an ongoing basis. She noted that the Association had advertised for volunteers in the last newsletter, and they have had about 7 residents reply. Currently they are looking at meeting one Saturday a month for 5 or 6 months during the year. President Bieschke stated that there is a half-way house he recently became aware of in Cherryland that houses non-violent parolees. He stated that the men at this facility already do clean up through out Cherryland and suggested that they help with San Lorenzo's group to help with graffiti. Deputy Liskey stated that he would run a check on the house to see if there have been any problems with those currently housed there or in the past.

8.4 Budget proposal for FY 2007-08 -- See Attachment B. The Administrator noted that she has had no comments on the budget. The final Budget was posted in the March/April newsletter for all residents and homeowners to review.

Director Sherman made a motion to approve the final budget for fiscal year 2007/2008. Director Pebelier seconded. The motion carries unanimously.

9.0 PUBLIC COMMENT -- Resident Keith Barros said the he would like the Board to consider raising the Association's yearly assessment in the next several years so that it is in line with the cost of living. This would help to acquire the monies that are needed to service the area better.

10.0 COMMITTEE REPORTS

10.1 Blue Ribbon Steering Committee - Wulf Bieschke -- President Bieschke reported that the committee has reached one of its final steps which is to form a leadership committee. This committee will reach out to community volunteers to help form this leadership group. The Blue Ribbon will host this outreach in a meeting on May 15, 2007 in the Association's community hall. Pamphlets regarding this meeting were available for residents. President Bieschke stated that the more that he gets involved in this committee, the more he sees that it is not altering the General Plan in any way. He stated that it is more about the "livability" of a community. The "health" of a community. Access to transit, sidewalk and road conditions and other issues related to all around "healthy" community that is providing adequate resources for those who live in it.

11.0 COMMENTS FROM BOARD MEMBERS -- Director Sherman apologized for not being at the last meeting. He noted that he did try and attend a little after 9 pm, however the meeting had already adjourned. Director Pebelier thanked all the residents who were in attendance.

President Bieschke invited residents to attend the Neighborhood Watch Group meetings. They are the third Mondays of every month in the San Lorenzo Community Hall.
