ANNUAL MEMBERSHIP MEETING

February 21, 2008


The annual meeting of the San Lorenzo Village Homes Association Board of Directors was held Thursday, February 21, 2008.

1.1 CALL TO ORDER -- President Bieschke raps the gavel at 7:18 p.m.and makes an announcement relative to the establishment of an annual meeting quorum. President Bieschke noted that a quorum of the membership was not present.

1.2 President’s Report -- President Bieschke gave the President’s report for the year. See Attachment A.

1.3 Election Results -- President Bieschke announced that Mel Medeiros was the winner over Jim Sherman in the Association's election for board director. He would take Director Sherman's seat after the regular meeting tonight.

1.4 Adjournment -- President Bieschke adjourned the annual meeting at 8 p.m. to move on to the regular monthly meeting.

February 21, 2008


1.1 CALL TO ORDER -- The regular meeting of the San Lorenzo Village Homes Association Board of Directors was held Thursday, February 21, 2008. President Bieschke called the meeting to order at 8:01 pm.

1.2 SALUTE TO THE FLAG -- President Bieschke led the Board and the audience in the pledge of allegiance.

1.3 ROLL CALL -– Directors Wulf Bieschke, Jim Sherman, Margaret Wright, Kathy Martins and Pat Pebelier were all present.

1.4 PROCLAMATION FOR JIM SHERMAN BY SUPERVISOR ALICE LAI-BITKER -- Supervisor Alice Lai-Bitker presented Director Jim Sherman with a Proclamation commending him for his 21 years of service on the board and his outstanding volunteerism for the Board and the San Lorenzo Community.

2.O MINUTES FROM THE PREVIOUS MEETING -- Approval of Minutes of Meeting No. 1165, the regular board meeting on January 17, 2008, and the work session meeting No. 1166 held on February 6, 2008. Director Pebelier moved to approve the notes taken at Work session number 1166 and the Board minutes of January 2008, meeting Number 1165. Director Sherman seconds the motion. The Work Session notes and the Board minutes are approved unanimously.

3.0 COMMENTS FROM PUBLIC AGENCIES

3.1 CHP -- Officer Tuazon Reported on the following statistics for the past month:

Officer Tuazon noted that collisions for the San Lorenzo area have gone down. He noticed not only a dip in the statistics, but when he is on patrol. Residents seem to be slowing down and obeying the speed limit, which is evident even near the Arroyo High School. (See Attachment A)

3.2 SHERIFF’S DEPARTMENT -- Officer Liskey reported the following statistics (See Attachment B).

Officer Liskey noted that motor vehicle thefts in the entire area have been on the rise and have not decreased in the last year. He warned residents to be aware of anyone or anything suspicious in their neighborhoods, they should report it to the sheriff’s office. He also encouraged residents to form Neighborhood Watch groups in coordination with the Homes Association and his office. Director Martins asked the sheriff’s department to get something for the Association’s newsletter so that residents can be alerted.

Liskey reported that the sheriff’s office has been investigating several businesses in the unincorporated part of Alameda County, Hayward and Fremont. There were several facilities that were doing business as “beauty” shops or “nail” shops that were actually massage parlors/brothels. His department has 30 people in custody and there were several businesses involved in San Lorenzo, Cherryland, Castro Valley, Hayward and Fremont. Liskey stated that while all the businesses were run separately, they were in communication with each other and did share some clients.

A resident asked what can be done about copper wire theft. She works for the school district and they are experiencing a large number of these types of thefts. Deputy Liskey stated that his department is trying to work with the copper recyclers who buy this product, but they are not always accessible. He noted that Alameda County is trying to partner with other counties to write an ordinance which will hold the recyclers accountable.

Resident Frank Mitchell noted that there has been pellet gun vandalism to the businesses and cars along Bockman Road. Liskey stated that he would be relaying this information back to his department.

3.3 Supervisor Lai-Bitker -- Staff member Kevin Dowling thanked the Board for its support with the BMX proposal. His office is still working with the Skywest Homes Association to screen the area with trees or other vegetation to help mitigate the view of some of its affected residents. They are still getting elevations for the site which will be going back to the Hayward Area Recreation Board and finally the San Lorenzo School Board for approval.

Dowling stated that his office will be coordinating a meeting with FEMA, the county and affected residents when FEMA has the final map ready. Dowling would report back on the dates for the meeting.

Dowling encouraged residents to attend the Eden Livability Initiative Meeting. It is important that San Lorenzo residents voice their opinions so that they the concerns in this area are not overlooked. (See Attachment C).

3.4 Zoning Enforcement Report (See Attachment D).

3.5 Public Comment - Items Not on the Agenda -- None.

4.0 FINANCIAL REPORT

4.1 Approval of January 2008 Expenditures and discussion of significant variances -- The Administrator reported that there were no significant variances. Director Martins makes a motion to accept the financial report, Director Sherman seconds the motion carries unanimously.

5.0 ADMINISTRATOR’S REPORT

5.1 Informational Items -- The Administrator reported that anyone interested in receiving agendas on upcoming meetings or events should give her their email so that she can add them to the list give them notification. She announced that there would be a dinner-fund-raiser to help raise funds to continue to fight the proposed energy plant in Hayward. The event will be held in the Homes Association Community Hall, Friday, February 29, 2008 and she invited everyone to attend and support the cause.

6.0 OTHER BUSINESS (MOTIONS MAY BE REQUIRED)

6.1 Gametime Proposal Update -- Director Martins reported that this proposal went before the Board of Zoning Adjustments (BZA) last week and they were able to get the classification for the business changed so that it passed the committee. Director Martins commended the owner Mike Gourea who came before the Board last month and addressed all the questions and concerns in his business plan. Gametime will open in San Lorenzo soon and the owner is giving first priority to San Lorenzo residents prior to opening the enrollment up to residents in other areas. The business has a conditional use permit so that if they pose any problems to the community they can have their permit pulled.

The Administrator thanked Director Martins for all that she did to help the owner build a business plan and for her hard work in getting this business approved by the county.

6.2 Utility tax proposal for the unincorporated area -- President Bieschke reported that the unincorporated residents currently pay a 5.5 % tax on our utility bills for services in the unincorporated area such as the law enforcement, library and county zoning. There is a new proposal to increase this tax by 1 percent to help continue to pay for these services. The county will include Comcast cable in this tax as well as the other utilities. The proposition is on the June 2008 ballot. It is a general ballot, so that even those in the city areas will have to vote on it. This is so the proposition can pass with a simple majority vote and not have to receive two-thirds approval to get implemented. This money goes into the General Fund and is ear-marked for the unincorporated areas. President Bieschke said that the Administrator is part of the County Budget Review Committee and watches how this money is spent every year.

The Administrator noted that in the past the money has gone to the Libraries, the Sheriffs department and County Planning/Zoning for the unincorporated areas. She thanked Supervisor Lai-Bitker for helping to add a Sunset Clause to the proposal which would end twelve years after it is implemented. The Administrator added that the unincorporated area does not get taxed like the cities do for services. This tax helps to keep our services running and is needed to continue to keep them at the level they are now.

6.3 Results of the Medical Marijuana issue on the ballot -- The Administrator noted that a the residents voted the following on the Medical Marijuana Dispensary Issue. Yes: 692 (20.1%); No 2309 (67.4%); No opinion: 427 (12.5%) The board directed the Administrator to write a letter to the Board of Supervisors showing them the results of our community and ask that they not renew these establishments licenses when they come up for review as is a provision of their conditional use permits.

6.4 Tribute to Jim Sherman -- Each of the Board members and the Administrator praised Director Sherman for his 21 years of service on the board and to the community. Director Sherman was then given a proclamation from the Association Board. (See Attachment E).

7.0 COMMITTEE REPORTS -- There were no committee reports.

Director Pebelier makes a motion to approve the Liens and Violation report, Director Wright seconds, the motion carries unanimously.

9.0 HEARINGS AND VARIANCE ISSUES

9.1 Hearings

1. 15901 Via Descanso - Car port put up, no plans. Fine and check on status with county code enforcement.
2. 15760 Via Lunado - Lawn condition. Send a letter thanking owner for correcting violation, and asking them to paint around new windows that were put in over 6 months ago.
3. 16104 Paseo Del Campo - Multiple/Lack of General Maintenance. Owner contacted Association, needs a month to get car running, all other violations cleared. Will re-hear in March 2008.
4. 16047 Via Paro - Multiple Lack of General Maintenance. Thank owner for cleaning up property and ask for registration on small truck backed into driveway.
5. 16129 Via Paro - Revisit shed. Board needs a site visit. Will contact Owner within the month to schedule this.
6. 16065 Via Alamitos - Multiple/Lack of General Maint. Owner called and is asking tenants to remove within 30 days; possible re-hear In March 2008.
7. 947 Bockman Rd. - Storing Commercial Truck in Driveway. Owner came in and stated that he will remove by 4/08. Rehear in April 2008. Property is on the market to be sold.
8. 955 Bockman Rd. - Inoperative/stored vehicle. Owner contacted association, filled up tire and cleaned up car; will register within 1 month. Revist in March or April 2008.
9. 17020 Via Perdido - Lawn Maintenance. Fine and refer to attorney.
10. 17089 Via Media - Inoperative/stored vehicle.Owner cleaned up car, which runs; he needs to get it registered. Will rehear April 2008.
11. 811 Bockman Rd. - Multiple/Lack of Gen. Maint. Owner provided registration to Association, and cleaned up car. Sending letter asking them to take the vehicle off its “chalks”.

23. 1851 Bockman - Dirt Accumulation. Letter to owner outlining what needs to be done to avoid fine; revisit in 30 days.
24. 1780 Via Lucas - Shed not approved as submitted. Owner attended hearing and noted that he would make changes that were not approved by the board and call them to re-inspect By 4/08.
25. 1725 Bockman Rd. - Multiple/lack of gen. maintenance. Vehicle is registered; writing to owner asking to remove weeds around car and to remove bricks under tires.
26. 1766 Via Toyon - Unapproved shed in back yard. Owner will be asked to remove Within 30 days to avoid fine.
27. 16024 Channel St. - Unapproved garage conversion. Owner working with Association and county to re-convert door to garage; will revisit in 60 days.

35. 1497 Via Manzanas - Lawn Maintenance. Continued for 30 days.

9.2 Variances

1. 1157 Via Los Trancos - fencing material for backyard. Revisit from Summer 2007. Approved.

Director Martins made a motion to approve the Hearings and Variances Director Sherman seconds. The Motion carries unanimously.

10.0 PUBLIC COMMENT -- Resident Dorothy Partridge announced that there would be a library meeting next week regarding renovating the San Lorenzo Library. The meeting would be held in the library and would start at 7 p.m. Resident Keith Barros encouraged people to attend the Eden Area Livability meeting. He stated that San Lorenzo is under-represented and needs its voice heard.

11.0 COMMENTS FROM BOARD MEMBERS -- Director Sherman thanked everyone, and said he will still participate in community events. The Board thanked everyone for coming to the “Meet and Greet” prior to the board meetings and for staying for the regular meeting.

12.0 ADJOURNMENT -- President Bieschke adjourned the meeting 9:46 PM.

The reorganization meeting of the San Lorenzo Village Homes Association Board of Directors was held Thursday, February 21, 2008, immediately after the regular Board meeting No. 1167B.

1.1 CALL TO ORDER -- The Administrator, Nancy Van Huffel, called the meeting to order at 9:41 p.m.

2.0 REORGANIZATION OF THE BOARD

2.1 Election of the President -- Director Pebelier makes a motion to nominate Director Bieschke as President, Director Wright seconds, the motion carries unanimously.

2.2 Gavel Turned over to new President -- The gavel is turned over to Director Bieschke who continued with the rest of the meeting.

2.3 Election of Vice President -- Director Wright makes a motion to nominate Director Martins as Vice President, Director Pebelier seconds, the motion carries unanimously.

2.4 Election of Secretary-Treasurer -- Director Martins makes a motion to nominate Director Pebelier, Director Wright seconds, the motion carries unanimously.

3.0 OTHER BUSINESS AS DIRECTED BY THE PRESIDENT

3.1 Remarks by Board Members -- Each board member welcomed newly elected member Mel Medeiros to the Board. Director Medeiros thanked Jim Sherman, his family and the residents who supported him, and stated that he looks forward to the upcoming year.

3.2 Appointment to Committees -- It was the consensus of the board to postpone the appointments until they could discuss it in the next work session.

4.0 ADJOURNMENT -- President Bieschke adjourned the meeting at 9:58 p.m.
