SAN LORENZO VILLAGE HOMES ASSOCIATION
MEETING NO. 1139

January 18, 2007


1.1 CALL TO ORDER -- The regular meeting of the San Lorenzo Village Homes Association Board of Directors was held Thursday, January 18, 2007. President Ledesma called the meeting to order at 7:35 pm.

1.2 SALUTE TO THE FLAG -- President Ledesma led the Board and the audience in the pledge of allegiance.

1.3 ROLL CALL -- Directors Patrick Ledesma, Wulf Bieschke, Jim Sherman, Peggy Sheridan and Pat Pebelier were present.

2.O MINUTES FROM THE PREVIOUS MEETING -- Director Sheridan moved to approve the notes taken at Work Session Number 1138 that were heard on January 11, 2007 and the Board minutes of December 21, 2006 of meeting Number 1137. Director Pebelier seconds the motion. The Work Session notes and the Board minutes are approved unanimously.

3.0 COMMENTS FROM PUBLIC AGENCIES

3.1 Alameda County Sheriff's Dept. -- Deputy Litsky gave statistics for the past two months .

Liskey noted that he knows there has been more vandalism and graffiti in the area than reported and encouraged people to call if they see vandalism in the area. He reported that they have been continuing "Operation Shoulder tap" to try and catch liquor or market establishments that are selling alcohol to minors.

Liskey said that their "Avoid the 21" campaign over this past holiday season arrested 380 people who were driving "under the influence", this is more than any year prior. He further stated that the sheriffs department has hired four (4) new technicians who will be enforcing abandoned vehicles and street sweeping tickets in the next few months.

Resident Mark Winshel asked Liskey if he was at the last Pacheco Neighborhood Watch meeting. He noted that he was and that they discussed the recent rise in vandalism in that area. The residents had suggested the street lights be replaced with brighter bulbs. Liskey spoke with staff at the Public Works department and the have agreed to re-illuminate the entire area.

Director Bieschke asked about the recent graffiti and whether it is gang related. Some of the recent tags can be seen all over the Village. Liskey stated that the Student Resource Officers (SRO's), are taking pictures and trying to track the graffiti but the District Attorney's office states that until a youth is actually seen doing the graffiti, they cannot prosecute.

3.2 CHP -- NO REPORT. The CHP was not present.

3.3 Supervisor Lai Bitker's Office -- Dowling reported that Alice Lai Bitker is having her annual State of the County Address the state of the county address would be held at the San Leandro Library on Thursday, January 25, 2007. The Unincorporated meeting would be held on 1/24/07 in the Homes Association Community Hall. Some of the items on the agenda would be: an update on the Creek Committee; Restaurant labeling and a discussion about the new septic tank requirement for unincorporated residents.

Dowling reported that there is a new person dealing with the Bockman Shopping Center project from the Olsen Company. They have offered to tear down the north side for the owner who is still in escrow, but he refused. Lai-Bitker will set up a meeting with the Olson Company, San Lorenzo Village Homes Association and Mr. Chang, the current owner to see if she can help facilitate progress with demolition of the north side of the shopping center. Dowling said that the county is not letting the Olson Company back down from their commitment to the retail portion of the project.

The Administrator suggested that Dowling set up a meeting with the Olson Company in the next two weeks. The escrow is not set to close until May 2007. Dowling stated that the new construction manager has not been available this week, but he will set up something soon.

Director Ledesma asked Dowling what is happening with the Economic Development in San Lorenzo. Dowling stated that they are still drafting a plan, he will check on the status and report back at the next meeting.

3.4 Zoning Enforcement Report (See Attachment B).

3.5 Public Comment - Items Not on the Agenda

Director Ready gave an update from the Planning Commission. She stated that the Eden General Plan will be postponed again. There has been discussion that the San Lorenzo Creek may not have the capacity needed, they need to add an addendum to the document prior to the Plan going to the Board of Supervisors in May 2007.

Ready asked that residents keep their ears open about the slurry pond issue. She said that when Cal Trans tops the freeways, it puts the residue into a slurry pond to dry out. These ponds may be toxic, depending on who you talk to. The county is trying to limit where slurry ponds can be put. Ready said that as a community we need to pay attention to the restrictions and where they can or cannot be put in our community. It is discussed about allowing these slurries in d "C 1 " and "M " districts which would include commercial. She noted that the "M" districts are similar to that at the end of Grant Avenue which is right near a wild life preserve and also where EBMUD is storing water for drought purposes.

President Ledesma asked two of the Association Director Candidates who were in attendance to stand up and introduce themselves. Richard Ogg and Margaret Wright stood up and acknowledged the audience.

4.0 FINANCIAL REPORT

4.1 Approval of December 2006 Expenditures and discussion of significant variances -- Director Bieschke made a motion to approve the December 2006 expenditures, Director Sheridan seconds, the motion carries unanimously.

The Administrator noted that the Association is up over 50% in Hall rentals in comparison with last year.

5.0 LIENS AND VIOLATIONS REPORTS

6.0 HEARINGS AND VARIANCE ISSUES

6.1 Hearings

1. 15901 Via Descanso - Multiple Violations/Lack of Gen. Maint., Car stored in driveway. Fine, Refer to county and revisit if county cannot abate problem.
2. 16037 Via Segundo - Lack of General Maintenance, Van stored in driveway. Van is gone, Close.
3. 16108 Via Primero - Trailer stored in driveway. Gone, Closing.
4. 537 Paseo Del Rio - Inoperative/stored vehicle on lawn. Gone, closing.
5. 15726 Via Corta - Lack of front yard maintenance/condition of paint of house. Owner wants to be present; Continue in 30 days when owner can be present.
6. 574 Paseo Del Rio - Ongoing parking on lawn. Gone, but monitoring ongoing lawn maintenance.
7. 15769 Via Corta - Stored/Inoperative vehicle. Gone, Closing.

Revisit the Following Properties:

1. 15824 Via Alamitos -- Status of vehicle and general maintenance of property: Property to be re-inspected. Thought vehicle was gone; board member saw vehicle in driveway.
2. 17243 Via Annette -- Status of car and debris on porch: Debris still present. Refer to county and fine.

6.2 Variances

1. 15996 Via Granada - Side yard lot, wants fence around it (bringing in plans and will be present). Board denied as submitted, asked owner to bring back with more specifics.
2. 15809 Via Alamitos - Application for side yard fence to street to prevent accidents with cars/house. Continue for 30 days, waiting for county response.
3. 15801 Via Seco - Patio Room with white aluminum roof; heard 1/11/07.
4. The Berm issue in the village - All berms will be treated the same as lawns; if they are unkempt or are left with only dirt they will be addressed pursuant to "Lack of general Maintenance"; if they have mowed grass or are landscaped they will be deemed in accordance with the Association's Codes and Restrictions.
5. Set Backs on corner lot -- The Administrator stated that the Association will have to take a closer look at fence applications on corner lots. The county regulation is a 30 foot set back from the center of the street, where she thought it was only a 20 ft setback. She is discussing this with the County zoning to try and get some changes, but any corner fence applications will be treated differently until changes in the zoning ordinance occur.

Director Sherman approved the Hearings and Variances as read, Director Bieschke seconds, the motion carries unanimously.

7.0 ADMINISTRATOR REPORT

7.1 Informational Items -- Administrator reported that there is a new business in the Lorenzo Manor Shopping Center. It is called "Play and Trade" and they resell and trade video games. Their grand opening will be held this week.

The Administrator stated that the date for counting the ballot was wrong. It should be Tuesday February 6, 2007 not the 5th as was published in the past newsletter.

Director Ledesma will be calling a formal meeting for election ballot counting at 9 am on February 6, 2007. There will be one item on the agenda: To count the ballots for the purpose of seating two new board members.

7.2 Status of Bockman Road -- The Administrator noted that Kevin Dowling already reported on this issue and she had nothing to add.

The Administrator stated that a letter will be forwarded by President Ledesma to the Civic Partners Developers requesting that the developer show a "good faith effort" in trying to retain a retailer to the Village Square area. The letter outlines specifics of this "good faith" effort. First, asking them to let us know what trade shows they are attending to solicit a retailer for the project. Second, what retailers they have approached who have turned down the opportunity to develop in the area. Next, that they put a sign on the vacant buildings indicating that there is retail for sale and last that they print a full page ad in the local newspapers stating their commitment to the community and the project.

The Administrator stated that the board plans to give Civic Partners a list of types of retail groups that would be acceptable. Three-hundred retailers have been identified and will be reviewed at next work session and cut to about 100 to give to Civic Partners.

9.0 PUBLIC COMMENT -- Related to San Lorenzo Village - Personal Priorities for 2007

President Ledesma asked the Board and the audience to think about what they want for the coming year and to discuss it.

Resident Kathie Ready said she would like to see more of a commitment to stay on top of the CC&R enforcement.

Resident Barros noted that his discussions with the San Lorenzo District about a safety Measure in front of San Lorenzo High with the Lewelling widening project have been turned down. He notes that his suggestion would have caused an "invisible curb" and caused more accidents/safety problems. Once he got all the information from both the School District and the County it made more sense to not include this curb.

Barros also talked about speed enforcement and the issue of raising speed limits on roads due to speed traps. He stated that he believes it is lack of enforcement and not a speed trap issues that is the cause and he would like residents to be aware of this issue as it relates to San Lorenzo roads.

It was discussed about raising home owner association dues to fund local projects. The Administrator noted that the Sterling Davis Act does not allow fees to be raised more than 20% per year.

Director Ledesma suggested that the Board reach out to other Supervisors to build a better relationship with other politicians who can help support issues related to San Lorenzo.

Director Sheridan agreed with Ledesma. The Board needs to maintain its current good relationships with Supervisor Lai-Bitker, Steele, and Miley. She stated that CC&Rs should be a top priority but the board should look at how it can reach out to other county politicians to possibly help and support when they are dealing with the Civic Partners development and other issues.

The Administrator stated that the CC&Rs are important for maintaining property values. However, so is the development that is coming into our area. She noted that with the size of the Association, and the limited staff, it sometimes is difficult to stay on top of all the issues.

Director Bieschke said that he would like to see more people get involved. He appreciates the same people who come to the Board meetings, however, he wants to reach out to others to try to get more involvement and to create more "community".

Resident Donald Clowser suggested that the Community Center be utilized more for the youth. He stated that there used are lots of events in the Hall for teens and youth. He would like to see the Association reach out to its young population and create more activities for them.

10.0 COMMITTEE REPORTS -- None.

11.0 COMMENTS FROM BOARD MEMBERS -- The Board members thanked all in attendance and especially the candidates running for Association director for attending.

12.0 ADJOURNMENT -- President Ledesma adjourned the meeting 9:28 PM.
